Oklahoma Childcare Subsidy for Relative Caregivers: Eligibility and Zero-Copay Rules

Childcare is one of the biggest expenses that blindsides grandparents who suddenly have a toddler or school-aged child in the house again. Oklahoma's childcare subsidy program covers part or all of the cost — and the rules are more generous for relative caregivers than most people realize.

How the Subsidy Works for Kinship Caregivers

OKDHS administers subsidized childcare under OAC 340:40-7-8. To qualify, you need to establish a recognized "need factor" — a reason you can't be home with the child during care hours. Accepted need factors include:

  • Employment (full-time or part-time)
  • High school or post-secondary enrollment
  • Job training programs
  • Substance abuse treatment

The Minimum Wage Exemption for Relatives

Here's the rule most people miss: under OAC 340:40-7-8(3)(E), a caretaker relative who is not the child's legal and financial parent is exempt from the federal minimum wage earning threshold. Biological parents must earn at least minimum wage to qualify for the subsidy. You don't. You still need to establish a recognized need factor, such as employment, education, job training, or substance abuse treatment.

Zero Copay for Kinship Foster Care

If the child is in OKDHS custody and formally placed in your home as a kinship foster care arrangement, the copayment drops to $0. You receive fully subsidized childcare with no out-of-pocket cost.

For children receiving Child-Only TANF (the most common situation for informal kinship caregivers), copayments are calculated on a sliding scale based on household income and unit size.

How to Apply

Childcare subsidy applications go through your local OKDHS county office. You can include childcare on your initial benefits application (Form 08MP001E) or apply separately. Once OKDHS verifies your need factor and completes an interview, the turnaround is fast — just 2 business days after providing the required documentation.

You'll choose from licensed childcare providers in your area. OKDHS pays the provider directly up to the program's maximum rate, and you cover any remaining copayment.

Combining Childcare with Other Benefits

Childcare subsidy stacks with other kinship programs. A grandparent can simultaneously receive TANF Child-Only cash for the child, SNAP for groceries, SoonerCare for the child's health coverage, and subsidized childcare. Each program has its own income rules, but there's no penalty for being enrolled in multiple programs at once.

Our Oklahoma Kinship Financial Help Guide maps out how all these programs interact — including which income counts where and how to apply for everything on one visit to your county office.
