Oklahoma Informal Kinship Care Benefits for Relatives Raising Children

You Do Not Need a Court Order to Get Financial Help

Most grandparents, aunts, uncles, and other relatives raising children in Oklahoma are doing it informally. There is no court order, no OKDHS case, no foster care license — just a child who needed a safe place and a relative who stepped up. If that describes your situation, you are not locked out of state benefits. Oklahoma offers several programs specifically designed for informal kinship caregivers, and the biggest one — Child-Only TANF — does not even look at your income.

The common misconception is that you need legal custody or guardianship before you can apply for anything. That is wrong. Informal physical care of a relative's child is enough to apply for cash assistance, food benefits, health coverage, and child care subsidies through separate applications. Each program has its own eligibility rules, but a court order is not a threshold condition.

Child-Only TANF: Cash That Ignores Your Income

Child-Only TANF is the single most important program for informal kinship caregivers in Oklahoma. When you apply as a non-needy caretaker relative under OAC 340:10-3-56, OKDHS evaluates the child's eligibility without counting your earnings, retirement income, Social Security, savings, or any other personal resources. Only income belonging to the child — such as Social Security survivor benefits or child support paid through OKDHS — is counted against the grant.

The maximum monthly payments under Appendix C-1, Schedule IX(B) are:

  • 1 child: $104
  • 2 children: $205
  • 3 children: $289
  • 4 children: $373
  • 5 children: $448

You qualify as a caretaker relative if you are related to the child within the fifth degree by blood, marriage, or adoption. That includes grandparents, great-grandparents, aunts, uncles, great-aunts, great-uncles, siblings, nieces, nephews, and first cousins. The child must be under 18, live with you in Oklahoma, and have been deprived of parental support through absence, death, incapacity, or unemployment.

You are not subject to work requirements, and there is no lifetime limit on Child-Only TANF benefits.

Apply through OKDHSLive.org or by submitting Form 08MP001E at your county OKDHS office. When you apply, specify that you are requesting Child-Only TANF as a non-needy caretaker relative — this is critical, because the standard TANF application path assumes you want to be included in the benefit unit, which triggers income testing and work requirements.

SoonerCare: Health Coverage for the Child

SoonerCare (Oklahoma Medicaid) covers children under 19 based on the child's household income using Modified Adjusted Gross Income (MAGI) rules. When you are an informal kinship caregiver, your income is excluded from the child's eligibility determination. Most children in informal kinship care qualify.

Apply through the MySoonerCare portal at okhca.org or include the health coverage request on your OKDHS Form 08MP001E. SoonerCare provides comprehensive medical, dental, and behavioral health coverage with no copays for children.

Once approved, the child receives 12 months of continuous eligibility. The annual renewal is largely automated — OHCA checks state records first, and only contacts you if automated verification fails.

SNAP, WIC, and School Meals

SNAP (food stamps) works differently from TANF. There is no child-only option. Everyone in the household who purchases and prepares food together is counted as one SNAP unit, and your income is included in the calculation. That said, households with a member aged 60 or older qualify for enhanced deductions — uncapped excess shelter deductions and a medical expense deduction for out-of-pocket costs exceeding $35 per month.

Children receiving Child-Only TANF or SNAP, or placed in foster care, are directly certified for free school meals without a separate income-verification application. If the child is under five and receives SoonerCare or SNAP, that enrollment establishes adjunctive income eligibility for WIC; the caregiver still applies through a WIC provider.

Child Care Subsidies

OKDHS subsidized child care is available if you have an established need factor — employment, enrollment in high school or post-secondary education, job training, or substance abuse treatment. As a non-needy caretaker relative, you are exempt from the federal minimum wage earning requirement that applies to biological parents. Copays are scaled to your household income and size.

If the child is in OKDHS child welfare custody and placed in your home, the copay drops to $0. For informal kinship arrangements, the copay depends on your financial situation, but the subsidy still significantly reduces what you would pay out of pocket.

What Informal Care Does Not Include

Being an informal caregiver means the child is not in OKDHS child welfare custody, which excludes you from two higher-paying programs:

Foster care maintenance payments require the child to be in state custody and the caregiver to have an approved or licensed foster home. These pay age-tiered daily rates that are substantially higher than Child-Only TANF.

TANF Supported Permanency and Title IV-E Subsidized Guardianship both require prior OKDHS custody and a transition to permanent guardianship through the child welfare system. Supported Permanency pays specialized rates under Schedule XVII. IV-E Guardianship can pay up to 100% of the foster care rate.

If the child's situation involves abuse or neglect and you believe OKDHS should be involved, contact the Child Abuse Hotline at 1-800-522-3511. A child welfare case could open a path to higher financial support through foster care or subsidized guardianship — but it also brings agency oversight and court proceedings.

Getting Started

The practical first step is to apply for Child-Only TANF and SoonerCare simultaneously through OKDHSLive.org or your county OKDHS office. SoonerCare or SNAP enrollment can establish adjunctive income eligibility for WIC, but the child still needs WIC certification. Children receiving Child-Only TANF or SNAP, or placed in foster care, are directly certified for free school meals without a separate income-verification application.
