CLEAR Legal Aid and Free Help for Washington Kinship Caregivers

The Resources Exist — Finding Them Is the Problem

Washington has a surprisingly robust set of free legal services, self-help forms, and support programs for kinship caregivers. The problem is that they're run by different agencies, located on different websites, and none of them hand you a single packet that covers everything. A grandparent who just took in a child overnight does not have the bandwidth to navigate three state agencies, two legal aid organizations, and a county Area Agency on Aging before the school enrollment deadline.

Here's where the real help is and how to reach it.

CLEAR: Free Legal Advice by Phone

CLEAR (Coordinated Legal Education, Advice and Referral) is Washington's statewide legal aid hotline, run by the Northwest Justice Project. It provides free civil legal screening, advice, and referrals.

  • General line: 1-888-201-1014
  • Seniors 60+: 1-888-387-7111 (regardless of income)

CLEAR can advise you on whether you need a kinship caregiver health declaration or a parental power of attorney, whether your situation warrants formal guardianship, and what your rights are when a school or medical provider refuses your paperwork. They can also refer you to a local legal aid attorney for ongoing representation if your case is complex.

The limitation: CLEAR provides advice over the phone. They direct you to the right forms and explain your options, but they do not prepare completed document packets for you. Wait times can be long, especially during morning hours. Try calling right at the line's opening time for the shortest hold.

Northwest Justice Project: The Forms People Actually Use

The Northwest Justice Project (NJP) maintains WashingtonLawHelp.org, the most reliable source of free, legally accurate self-help forms and guides for Washington residents. For kinship caregivers, the key resource is the Health 752 declaration — the standardized Kinship Caregiver's Declaration of Responsibility for a Minor's Health Care.

This is the form that implements RCW 7.70.065. It lets a relative caregiver consent to a child's medical, dental, and mental health care without a parent's signature or a court order. Healthcare providers across Washington recognize it.

NJP also publishes plain-language legal information sheets on topics like school enrollment rights, FERPA access for caregivers, McKinney-Vento eligibility, and when to consider formal guardianship. Everything is free and available in multiple languages.

WashingtonLawHelp.org is the site. Search for "kinship caregiver" or "relative raising a child" and you'll find the relevant forms and fact sheets.

Kinship Navigators Through Area Agencies on Aging

Washington's Kinship Navigator Program operates through local Area Agencies on Aging (AAA) and tribal organizations, funded by DSHS/ALTSA. Navigators provide:

  • Emotional support and peer connections
  • Referrals to financial assistance (emergency funds for clothing, school supplies, beds)
  • Help connecting to Kinship Caregivers Support Program (KCSP) funds
  • Guidance on accessing public benefits (Apple Health, TANF child-only grants, SNAP)
  • Links to local support groups

Navigators are not lawyers and cannot give legal advice or draft legal documents. But they know the local landscape — which school districts are cooperative, which providers accept caregiver declarations without pushback, and which community organizations offer respite care or grandparent support groups.

To find your local Kinship Navigator, contact your county's Area Agency on Aging or call the DSHS Kinship Care line.

Support Groups

Kinship caregiver support groups meet across Washington — some in person, some virtual, some through churches or community centers. The most reliable way to find one is through your local Area Agency on Aging or through a Kinship Navigator referral.

These groups are not therapy and they're not legal clinics. They're other grandparents and relatives raising children who understand the exhaustion, the grief, the financial strain, and the bureaucratic frustration. Many caregivers report that the practical tips shared in support groups — which pediatrician's office accepts the form without questions, how to handle a school registrar who insists on court papers — are more immediately useful than anything they find online.

PAVE: Special Education Advocacy

If the child has a disability or suspected learning difference, PAVE (Partnerships for Action, Voices for Empowerment) provides free training and support for IEP meetings, special education evaluations, and 504 accommodation plans. They can attend IEP meetings with you and help you understand your rights as a kinship caregiver acting as the child's educational "parent" under WAC 392-172A.

PAVE's toll-free line: 1-800-572-7368.

The Office of the Education Ombuds

The Governor's Office of the Education Ombuds (OEO) is a free statewide service that helps families resolve school conflicts. If a district refuses to enroll a child, disputes your caregiver authorization, or creates barriers to the child's education, OEO can mediate directly with the school district.

OEO toll-free: 1-866-297-2597 or oeo.wa.gov.

Putting It Together

Free resources get you the individual forms and phone advice. What they don't give you is the organized, step-by-step system — which forms apply to your specific situation, how to fill them out correctly, what to do when a provider refuses, and how all the pieces (health declaration, school authorization, parental POA, insurance enrollment) fit together.

The Washington Consent Guide for Kinship Caregivers fills that gap — every form, every deadline, every escalation script in one place, written for someone who does not have time to call three hotlines and read four websites before the doctor's appointment tomorrow morning.
