Kinship Care in Washington State: What Relative Caregivers Need to Know

The phone rings at 11 p.m. and by morning you are feeding breakfast to a grandchild, a niece, a nephew who was not living with you yesterday. In Washington State, kinship caregivers frequently assume daily care of a child without prior court intervention.

Washington calls this kinship care. The state has a layered set of statutes, agency programmes, and district policies that let you handle day-to-day parenting tasks without going to court, but the pieces are scattered across different agencies and none of them hand you a single packet that covers everything.

The Two Things You Need First

Almost every immediate barrier — the school registration desk, the pediatrician's intake form, the dentist's front office — comes down to two questions: can you enrol this child in school, and can you consent to their medical care?

Medical consent runs through RCW 7.70.065. A written declaration under penalty of perjury, signed by a qualifying relative, lets you consent to routine outpatient medical, dental, and mental-health care for six months at a time. No parent signature is required.

School enrolment runs through OSPI policy and district-level caregiver authorisation forms. Washington districts cannot require a court custody order as a condition of enrolment. The child has a constitutional right to attend school in the district where they currently live, and proof of residency plus a caregiver affidavit is enough.

Where Washington's Authority Instruments Stack Up

Washington gives informal caregivers three tiers of authority, each with its own reach and its own limits:

Instrument Parent must sign? Maximum duration What it covers
RCW 7.70.065 health declaration No 6 months (renewable) Medical, dental, mental-health consent
Parental Power of Attorney (RCW 11.130.145) Yes 24 months Care, custody, property — school + medical
Minor Guardianship (RCW 11.130) Court order Until the court says otherwise Full legal custody

Most caregivers start at the declaration level. If the parent is willing and reachable, a power of attorney adds school authority and lasts four times as long. Guardianship is the option when informal instruments are not enough — the parent is actively opposed, the child needs to stay permanently, or you need to access child support or certain benefits.

Support Resources That Actually Help

Washington funds Kinship Navigators through Area Agencies on Aging across the state. A navigator will not draft your legal documents, but they will connect you to financial help, respite care, and local support groups. The DSHS Kinship Care page lists navigators by county.

For legal questions, the CLEAR hotline (1-888-201-1014) provides free legal screening. WashingtonLawHelp.org publishes the NJP Health 752 declaration form and plain-language guides to the caregiver statutes.

Apple Health for Kids (Washington's Medicaid/CHIP programme) covers children in kinship care based on the child's own income status. Applications go through Washington Healthplanfinder or Washington Connection — you do not need legal custody to apply.

The Gaps Nobody Tells You About

The six-month expiry on the health declaration catches people. So does the fact that the declaration covers medical consent but not school enrolment — you need a separate caregiver authorisation form from the district.

Special education is one area where informal caregivers have more authority than they realise. Under WAC 392-172A-01125, a relative with whom the child lives qualifies as a "parent" for IEP meetings, evaluations, and consent — no additional paperwork needed.

And if you are caring for a teenager aged 13 or older, Washington's minor self-consent laws mean the teen can access mental health and substance-use treatment on their own authority. You may not even be told about it.

Our Washington School and Medical Consent Guide pulls all of these threads together — every instrument, every form, every expiry date — in one organised reference with the escalation scripts and renewal trackers that the free agency resources leave out.
