Rhode Island McKinney-Vento Kinship School Enrollment

A child lands on your doorstep because the parent lost housing, and the school says you need transcripts, immunization records, and proof of address before they will register the child. You have none of those things yet. The McKinney-Vento Homeless Assistance Act may cut through every one of those barriers.

When McKinney-Vento Applies to Kinship Families

McKinney-Vento defines homeless children and youth as those who lack a fixed, regular, and adequate nighttime residence (42 U.S.C. § 11434a(2)). That includes children who are sharing housing with relatives due to economic hardship, loss of housing, or a similar reason.

Not every child living with a grandparent qualifies. The living arrangement must stem from housing loss, economic displacement, or substandard living conditions — not simply a family preference. A child who moves in with a grandmother after their parent enters inpatient rehabilitation and loses the apartment would typically qualify. A child whose parents voluntarily send them across town to attend a preferred school district would not.

What the School Must Do

Once a child qualifies as a McKinney-Vento student, the district must:

  • Enroll the child immediately, even without a birth certificate, immunization records, academic transcripts, proof of residency, or guardianship papers.
  • Allow the child to stay in their school of origin if the family requests it and it is feasible.
  • Provide transportation to the school of origin if the family requests it.
  • Refer disputes to the LEA Homeless Liaison for resolution, not use missing paperwork as grounds to delay enrollment.

The school cannot condition enrollment on producing documents first and enrolling later. The enrollment must happen right away, and the caregiver can work on collecting records afterward.

How to Start the Process

Contact the school district's designated McKinney-Vento Homeless Liaison. Every local education agency in Rhode Island is required to have one. If you do not know who that person is, call the RIDE State Homeless Education Coordinator at (401) 222-8466.

Explain that the child is living with you because of a housing emergency and ask for immediate enrollment under McKinney-Vento. The liaison may ask about the current housing arrangement and what prompted the move to determine eligibility; RIDE's guidance recommends asking these questions sensitively, confidentially, and on a case-by-case basis.

McKinney-Vento vs. In Loco Parentis Enrollment

For kinship families with stable housing, the standard route is RIGL § 16-64-1 — the in loco parentis provision that allows a relative caregiver to enroll a child in the school district where the caregiver lives. That pathway requires proof of the caregiver's address and a statement explaining the living arrangement.

McKinney-Vento is the faster route when records are missing or the housing situation is unstable. The two are not mutually exclusive. A child can enroll under McKinney-Vento immediately and then transition to a standard in loco parentis enrollment once the living situation stabilizes and documents are gathered.

What McKinney-Vento Does Not Cover

McKinney-Vento gets the child into school. It does not give you authority to consent to medical treatment, sign for dental care, or make legal decisions on the child's behalf. For children under 16, Rhode Island has no statutory caregiver consent form — medical providers generally require either written parental consent or a probate court guardianship order.

The Rhode Island School and Medical Consent Guide covers both the school enrollment process and the medical consent pathways, including what to do when a parent is not available to sign.
