Mississippi School Residency Requirements for Grandparents Enrolling a Child
Mississippi school enrollment starts with one question: does this child physically live in the district? For grandparents and relatives who've taken in a child, proving residency is the gateway to getting the child into a classroom — and MDE Rule 68.1 spells out exactly how.
How Mississippi Defines Residency for School
State Board Policy Chapter 68, Rule 68.1 defines residence for school attendance purposes as the location where the student physically resides full-time — weekdays, weeknights, and weekends. Not where their parent lives. Not where they're "technically" supposed to be. Where they actually sleep every night.
This definition is what makes enrollment possible without custody. If your grandchild lives at your house full-time, your address is the child's residence for school purposes. The rule applies equally to grandparents, aunts, uncles, older siblings, and family friends.
The Two-Category Document System
Rule 68.1 requires proof from two distinct categories, all showing the same physical address.
Category I (at least one) — establishes the address:
- Filed homestead exemption application
- Current mortgage document or property deed
- Signed lease agreement (all pages required)
- Utility bill (electric, gas, or water) dated within 30 days
Disconnect notices, cut-off notices, property tax bills, and P.O. Box addresses are explicitly rejected.
Category II (at least one) — confirms identity at that address:
- Valid Mississippi driver's license or state ID
- Current-year automobile registration
- Voter registration card
- Official government mailing dated within 30 days
Cell phone bills, expired registrations, insurance statements, and junk mail don't qualify.
The Residency Affidavit
Some districts ask a non-parent enrolling adult to complete a local affidavit. Rule 68.1(2)(c) addresses the non-parent caregiver's residency documentation; the form and any notarization requirement are set locally. Jackson Public Schools' affidavit, for example, confirms:
- The child lives full-time with the enrolling adult
- The arrangement isn't established solely for school district selection or athletic purposes
The affidavit is a district form, not a statewide document. Some districts require the caregiver and the property owner (if the caregiver rents or shares a home) to both sign. Notarization requirements vary — check with the registration office before your visit.

Birth Certificate and Immunization Requirements
Beyond residency, every student needs:
Age verification under Miss. Code Ann. § 37-15-1. A certified birth certificate is standard, but the statute also accepts a passport, baptismal certificate with sworn affidavit, life insurance policy of two or more years, Bible record with sworn affidavit, prior school record of four or more years, or sworn affidavit of age. Kindergarten and first grade entry require mandatory age verification.
MSDH Form 121 — Mississippi's immunization compliance certificate. This is not a generic immunization card from a pediatrician. It's the specific Mississippi State Department of Health form. Out-of-state records must be converted to Form 121. Students in grades 2-12 get a 60-day grace period; K-1 students do not.
If you can't get Form 121 before enrollment, ask the school nurse or local county health department what records they need and what steps are required to obtain Form 121.
When Residency Proof Is Waived
If the child's living situation qualifies under the McKinney-Vento Homeless Assistance Act — including doubled-up housing due to economic hardship, fire, domestic disruption, or similar emergency — the district must enroll the child immediately without standard residency documentation. The district's homeless liaison handles document procurement after enrollment.
McKinney-Vento applies even when the child is staying with a grandparent or relative, as long as the shared housing arrangement results from a qualifying hardship. It's not limited to street homelessness.
District Differences to Watch
Jackson Public Schools uses a standardized non-parent residency affidavit and accepts in-loco-parentis arrangements under Board Policy JBE. Harrison County may send verification officers for home visits. Jackson County School District won't allow temporary enrollment without complete documentation and explicitly won't recognize a guardianship established solely for district residency.
Call ahead. Every district operates within the same state framework but implements it differently.
Beyond Residency
Proving residency is one part of enrollment. It doesn't automatically grant you authority over special education decisions, disciplinary hearings, or educational records access (though FERPA's definition of "parent" may cover you if the biological parent isn't participating). Our Mississippi School and Medical Consent Guide covers the full picture — residency verification, medical consent, power of attorney options, and the point at which informal authority gives way to court-backed guardianship.
