Kentucky Caregiver Affidavit and Fayette County Lexington School Enrollment

Fayette County Public Schools serves Lexington and is Kentucky's second-largest district. If you are a grandparent or relative caregiver enrolling a child in FCPS, the process combines electronic document submission with in-person verification — and the caregiver affidavit is your ticket through registration.

FCPS Registration for Kinship Caregivers

Fayette County Public Schools encourages electronic document submission through a central family resource portal while retaining paper verification at district intake offices. The typical enrollment path for a kinship caregiver:

  1. Access the FCPS enrollment portal: Begin the new student registration online through the district's family resource system.
  2. Submit the affidavit electronically: Upload a clear scan or photo of your notarized Caregiver's Authorization Affidavit (KRS 405.024 / KRS 158.144).
  3. Gather supporting documents: You will need the child's birth certificate, immunization records, and proof that the child lives at your Fayette County address (utility bill, lease agreement, or mortgage statement).
  4. Complete in-person verification: FCPS intake offices may schedule an appointment to review original documents. Bring the original notarized affidavit along with your government-issued photo ID.

What FCPS Must Accept

KRS 158.144 applies to every Kentucky public school district, including FCPS. The district must honor a valid caregiver affidavit for enrollment and cannot require:

  • A court custody order as a prerequisite
  • A guardianship decree
  • A biological parent appearing in person to authorize enrollment

If a registration clerk at an FCPS school asks for court papers, escalate to the school principal, the Director of Pupil Personnel, or the district's central enrollment office. KRS 158.144(4)-(5) protects school officials from civil and criminal liability and professional discipline when they rely on a valid affidavit in good faith.

Lexington-Specific Considerations

Lexington's urban density means FCPS has attendance zones and magnet school programs. A child enrolled under a caregiver affidavit attends the school assigned to your home address. The affidavit addresses caregiver authority and district enrollment; it does not by itself guarantee placement in a magnet program.

Central Kentucky also has strong kinship support infrastructure. The University of Kentucky's Kentucky Kinship Resource Center and the KY-KINS navigator program are headquartered in Lexington. If you need help beyond the enrollment process — connecting to legal aid, financial assistance, or peer support — KY-KINS intake is available through kyfaces.ky.gov or by calling 859-257-4785.

If Records Are Missing

Children in sudden kinship placements often arrive without immunization records or school transcripts. FCPS must provide interim enrollment while those records are requested from the prior school. Kentucky law gives a grace period for missing immunizations — the child starts class while you arrange catch-up appointments.
