What to Do When a Kentucky School Refuses Your Caregiver Affidavit

You walked into the school office with your notarized caregiver affidavit, and the registrar told you they can't enroll the child without a court custody order. It happens more often than it should. Kentucky law is clear that schools must honor valid affidavits — but front-desk staff aren't always trained on the statute. Here's how to push back effectively.

Kentucky Law Requires Schools to Accept Valid Affidavits

KRS 158.144(2)(b) says that a Kentucky public school district "shall" honor a properly executed caregiver authorization affidavit for any child residing in the caregiver's home within that district. The word "shall" is mandatory. Requesting a court custody decree or guardianship order as a condition of enrollment — when a valid affidavit is presented — goes against the statute.

The statute allows an enrollment official to refuse if there are reasonable grounds to believe the affidavit is being used solely to gain athletic eligibility or circumvent school assignment or boundary policies. A school must also refuse a caregiver's decision if it has actual knowledge that a parent, de facto custodian, guardian, or legal custodian has made a superseding decision.

Step-by-Step Escalation

Step 1: Ask for a written refusal. Request that the administrator put their refusal in writing, citing the specific legal or policy basis. Most refusals happen because the registrar is unfamiliar with the law — asking for written documentation sometimes prompts them to check with their supervisor first.

Step 2: Show them the statutory reliance protection. KRS 158.144(4)-(5) says a person relying in good faith on a valid affidavit has no duty to investigate further and is not subject to civil or criminal liability because of that reliance. Print out the relevant statute sections and bring them with you.

Step 3: Escalate within the district. If the front-desk staff won't budge, go up the chain:

  • Director of Pupil Personnel (DPP) — every Kentucky school district has one, and enrollment is their responsibility
  • District Superintendent's office
  • District General Counsel — school districts have legal staff who will recognize the statutory requirement

Step 4: Contact the McKinney-Vento Liaison. If the child lacks a fixed, regular, and adequate nighttime residence — for example, because the family lost its home, was evicted, or is sharing housing due to hardship — the federal McKinney-Vento Act may provide immediate enrollment rights even when documents are missing. Every district has a designated McKinney-Vento Homeless Liaison.

Step 5: Get outside help. Kentucky has free legal resources for kinship caregivers:

  • AppalReD Legal Aid — serves eastern Kentucky
  • Legal Aid Society — serves the Louisville metro area
  • Legal Aid of the Bluegrass — serves central and northern Kentucky
  • Kentucky Legal Aid — serves western Kentucky
  • KY-KINS (Kentucky Kinship Information, Navigation and Support) — peer navigators through the University of Kentucky, reachable through the KY FACES portal at kyfaces.ky.gov or at 859-257-4785

A phone call from a legal aid attorney to a school district office usually resolves the issue within a day.

Why This Happens

School staff interact with custody and guardianship documents daily. The caregiver authorization affidavit is less common, and many registrars default to requesting what they see most often — court orders. This isn't malicious; it's a training gap. The statute was enacted in 2014, but district-level training on it varies widely.

Rural districts typically handle affidavits at the building level through the registrar or DPP, while large urban districts like JCPS (Louisville) and FCPS (Lexington) route them through centralized enrollment centers where staff see a higher volume and are more likely to recognize the document.
