Kentucky School Enrollment Documents for Relative Caregivers

One of the most stressful parts of kinship caregiving is getting a child into school when you do not have all the paperwork. The parent may not have handed over immunization records. The birth certificate might be at an address you cannot access. Prior school transcripts could be in a different county or a different state.

Kentucky provides interim enrollment when prior school records are unavailable and a grace period for missing immunization or health records — but you do need to know what is required, what can wait, and how to get missing records.

Documents Schools Can Request

When enrolling a child under a caregiver affidavit, Kentucky school districts may ask for:

  • Notarized Caregiver's Authorization Affidavit — your primary legal document under KRS 405.024 / KRS 158.144
  • Proof of residence in the school district — utility bill, lease agreement, or mortgage statement in your name
  • Child's certified birth certificate — the official version with a raised seal, not a hospital keepsake copy
  • Immunization records — Kentucky Certificate of Immunization Status
  • Physical examination records — the state-required preventive health care examination
  • Prior school transcripts — academic records from the child's previous school

Documents Schools Cannot Require

Under KRS 158.144, a school district must not demand the following as a prerequisite to enrollment when you present a valid caregiver affidavit:

  • A formal court custody decree
  • A judicial guardianship order
  • The biological parent's in-person consent or signature beyond what appears on the affidavit

If a registrar insists on a court order despite a valid affidavit and no statutory exception, that conflicts with KRS 158.144. Escalate to the Director of Pupil Personnel.

When Immunization Records Are Missing

Kentucky requires specific immunizations for school enrollment, but the law also provides a grace period. If the child arrives without an immunization certificate:

  1. The school must enroll the child provisionally
  2. You have a defined period to get the child vaccinated and provide the certificate
  3. The child attends class during the grace period — they are not excluded

Schedule a pediatric appointment as soon as possible. The caregiver affidavit authorizes you to consent to immunizations under KRS 405.024(1)(f)(1), which specifically includes CDC-recommended vaccines. If the child has no established pediatrician, your county health department provides vaccinations, often on a walk-in basis.

Getting a Birth Certificate

If the parent did not give you the child's birth certificate, you can request a certified copy from the Kentucky Office of Vital Statistics (for Kentucky-born children) or the vital records office of the child's birth state. Check the application instructions for identity and eligibility requirements; the office may request additional documentation before issuing the record.

Kentucky charges $10 for a certified birth certificate; online or telephone orders through VitalChek and expedited delivery may add fees. Mail orders can take up to 30 business days for processing and delivery. The Frankfort office offers in-person service, but same-day service is not guaranteed after 3:45 p.m. Eastern Time.

Requesting Prior School Records

Once the child is enrolled in the new school, the receiving district requests academic records from the former school — you do not have to do this yourself. Under FERPA, schools transfer records to a new enrolling school without requiring additional parental consent.

If records are slow to transfer (common when the prior school is out of state), the new school creates a temporary academic plan based on age-appropriate grade placement. Testing and teacher assessments in the first weeks help place the child in the right classes.

McKinney-Vento Protections

If the child's kinship placement resulted from a housing crisis — eviction, domestic violence, shelter stay — the federal McKinney-Vento Act may provide additional protections beyond the caregiver affidavit. McKinney-Vento provides immediate enrollment, waiver of missing documents, and transportation assistance. Ask the school district's McKinney-Vento Homeless Liaison whether the child qualifies.

A kinship placement into stable housing (your home, where you have lived for years) does not automatically trigger McKinney-Vento. The act applies when the placement stems from housing instability, not simply from a change in caregiver.
