How to Enroll a Grandchild in School in Kentucky Without Custody

Your grandchild just moved in and the school year is already underway. You don't have a court order. You're not the legal guardian. And when you call the school, the registrar asks for custody paperwork you don't have. This is one of the most common problems Kentucky grandparents face — and Kentucky law has a specific answer for it.

The Caregiver Authorization Affidavit Covers School Enrollment

Under KRS 158.144, an adult relative caregiver who has a child living in their home can execute a notarized affidavit establishing authority to make school-related decisions. That includes enrollment, attendance, permission slips, extracurricular activities, disciplinary matters, and special education planning.

Kentucky public school districts are legally required to honor this affidavit. The statute says a school "shall" accept it for any child residing in the caregiver's home within that district. You do not need a court order, a guardianship decree, or the biological parent's physical presence at the school.

What You'll Need for Enrollment Day

Bring these documents to the school registrar:

  • Your notarized caregiver authorization affidavit — signed by you under penalty of perjury, with the required parent, de facto custodian, guardian, or legal custodian signatures, or a written explanation if a required signer is unavailable
  • Proof of your address in the school district — utility bills, a lease agreement, or similar documentation
  • The child's birth certificate — a certified copy
  • Immunization records — Kentucky requires specific vaccinations for school entry, though if records aren't immediately available the district must allow interim enrollment while you track them down
  • Prior school transcripts — if the child was enrolled elsewhere previously; if these are missing, the school requests transfer records from the previous district

Schools cannot demand a formal court custody decree or judicial guardianship order as a prerequisite for enrollment when you present a valid caregiver affidavit.

How the Big Districts Handle It

Enrollment processes vary across Kentucky's 171 school districts:

  • Jefferson County Public Schools (JCPS) in Louisville uses centralized online registration portals along with neighborhood enrollment centers. You'll upload your notarized affidavit during the digital intake process.
  • Fayette County Public Schools (FCPS) in Lexington accepts electronic document submissions through their family resource portal and also accepts paper affidavits at district intake offices.
  • Rural school districts typically handle enrollment through the school's own registrar or the Director of Pupil Personnel. Paper affidavits notarized at the county clerk are the norm.

When Records Are Missing

If you don't have the child's prior school records, immunization certificates, or medical forms at the time of registration, the school must establish interim enrollment. The child starts attending class while records are transferred. Missing immunizations need to be resolved within Kentucky's statutory grace period, but the child cannot be turned away from the classroom while you catch up.

The McKinney-Vento Safety Net

If the child's placement with you happened because of a housing crisis — eviction, domestic emergency, shelter stay, or family homelessness — federal law may provide additional protections. The McKinney-Vento Homeless Assistance Act offers immediate enrollment rights, waiver of missing documents, and transportation assistance.

A kinship placement by itself does not trigger McKinney-Vento protections. If the child is living with you in a stable, regular housing arrangement, standard KRS 158.144 enrollment applies. But if the background involves housing instability, ask the school for the district's McKinney-Vento Homeless Liaison.

Watch Out for the Athletic Exception

KRS 158.144 includes an anti-circumvention clause. A school can refuse the affidavit if the official has reasonable grounds to believe the document is being used solely to gain athletic eligibility or to get around school attendance zone policies. If your situation is genuine — the child actually lives with you because a parent can't care for them — this exception doesn't apply. But be prepared for the question if you're enrolling in a different district than the child previously attended.
