Idaho Benefits Appeal and Fair Hearing Process for Kinship Caregivers
When You Get a Notice of Decision You Disagree With
IDHW must send you a written Notice of Decision whenever your benefits are denied, reduced, or terminated. The notice must explain the reason for the action; a TAFI notice must also state the rule supporting it. If the reason is wrong — or if you believe IDHW miscounted income, misunderstood your living arrangement, or made a procedural error — you have the right to appeal.
Appeal Deadlines by Program
Each program has its own deadline. Miss it and you lose the right to challenge the decision:
| Program | Appeal Deadline |
|---|---|
| TAFI | 30 days from notice date |
| ICCP | 30 days from notice date |
| Medicaid (eligibility) | 30 days from notice date |
| Medicaid (service denial) | 28 days from notice date |
| SNAP | 90 days from notice date |
These deadlines run from the date on the written notice, not from when you received it. Open your mail promptly.
Keeping Benefits While You Appeal
In some cases, you can ask IDHW to continue benefits while an appeal is pending. When the notice allows continued benefits, request them within 10 days of the notice date. The right depends on the program and whether you remain eligible. If the hearing upholds IDHW's decision, you may have to repay benefits received during the appeal period.

How the Fair Hearing Works
A fair hearing is an administrative proceeding, not a court trial. A Fair Hearing Officer — independent from the caseworker who made the original decision — reviews the evidence and issues a ruling.
You can present:
- Documents showing your household situation, income, and the child's circumstances
- Copies of the application or recertification materials you submitted
- Witness statements from people who can verify your living arrangement
- Your own testimony explaining what happened
You can request an appeal by mailing the Fair Hearing Request form, writing by mail, email, or fax, or calling Self-Reliance Programs at 1-877-456-1233.
Common Reasons Kinship Caregivers Need to Appeal
- Income miscounted: IDHW counted the caregiver's income on a TAFI child-only application (it should be excluded)
- Relationship not accepted: the documentation you provided was not recognized as proof of the family connection
- Household composition error: IDHW grouped people into the wrong SNAP household
- Recertification missed: you submitted paperwork but it was not processed in time
Benefits Appeals Are Not Custody Hearings
An IDHW Fair Hearing Officer has no authority over custody or guardianship — those are court matters. Similarly, a magistrate judge cannot overturn an IDHW benefit denial. If you are dealing with both a benefit appeal and a guardianship issue, they are handled by completely separate systems.
Free Legal Help
If you cannot navigate the appeal on your own, two organizations provide free legal assistance to low-income Idahoans:
- Idaho Legal Aid Services (ILAS): statewide intake at 208-746-7541, covers benefit appeals, guardianship, and domestic violence cases
- Idaho Volunteer Lawyers Program (IVLP): 208-334-4500 (Idaho Law Foundation main line), coordinates pro bono legal help through the Idaho State Bar
The Idaho Kinship Financial Help Guide includes a step-by-step appeal workflow and deadline tracker to help you stay on top of the timeline from the moment you receive a denial notice.
