Wisconsin GF-223: Do Both Parents Need to Sign?
The short answer is: every parent who holds legal custody must sign. That rule sounds simple, but the details depend on whether the parents are married, divorced, unmarried, or separated — and getting the signatures wrong is the most common reason a Wisconsin GF-223 gets rejected at a school or clinic.
The Statutory Rule
Under Wis. Stat. § 48.979, a Power of Attorney Delegating Parental Power is only valid when signed by all parents holding legal custody of the child. Form GF-223 (issued by the Wisconsin Court System) includes separate signature blocks for this reason.
"Legal custody" in Wisconsin means the right to make major decisions for the child — schooling, medical care, religious upbringing. It is not the same as physical placement, which determines where the child lives day to day. A parent can have legal custody without having physical placement.
Married Parents Living Together
Both sign. Wisconsin presumes that married parents share joint legal custody unless a court order says otherwise.
Divorced or Separated Parents with Joint Legal Custody
Both sign. A divorce decree that awards joint legal custody means neither parent can delegate parental power alone. You need both signatures on the same GF-223, though they don't have to sign at the same time or in the same location. One parent can sign their section and mail or hand the form to the other.

One Parent Has Sole Legal Custody
Only the parent with sole legal custody needs to sign. Attach proof — such as a divorce decree, paternity order, or court judgment that specifically grants sole legal custody to that parent. Schools and clinics may ask to see the documentation, and the form without it invites challenges.
Unmarried Parents (Paternity Not Established)
If paternity has never been legally established, check the available paternity and custody records to identify who holds legal custody. Every parent who holds legal custody must sign the GF-223. If that status is unclear, ask Legal Action of Wisconsin or Judicare Legal Aid before relying on one signature.
Unmarried Parents (Paternity Established, No Custody Order)
When paternity is acknowledged or adjudicated but no court has issued a custody order, check the paternity and custody records to identify who holds legal custody. Every parent who holds legal custody must sign. If those records do not resolve the question, ask Legal Action of Wisconsin or Judicare Legal Aid before relying on one signature.
Incarcerated or Institutionalized Parents
An incarcerated parent who holds legal custody still needs to sign. Wisconsin correctional facilities provide notary services and social workers who can facilitate the execution of Form GF-223 inside the institution. Residential treatment centers operate similarly. The signed form is then mailed or handed to the designated agent.
What Happens if the Form Is Missing a Required Signature
A school registrar or clinic front desk has no obligation to accept a delegation of power that lacks a required custodial parent's signature. If you present a GF-223 signed by only one parent in a joint-custody situation, expect it to be declined — not because the staff is being difficult, but because the form on its face isn't legally complete.
If the other parent is unreachable or unwilling to sign, a GF-223 won't work. The alternatives are McKinney-Vento enrollment for school (which requires no parental signature), or petitioning for court guardianship, which can proceed over a parent's objection.
