Unsupported Child's Benefit vs Orphan's Benefit

Same Rates, Different Reasons

The Unsupported Child's Benefit (UCB) and the Orphan's Benefit (OB) pay identical weekly rates, come with the same supplementary allowances, and are both administered by Work and Income. The difference is entirely about why the child can't live with their parents.

When the Orphan's Benefit Applies

The OB is for a child whose parents have:

  • Both died, or
  • Can't be found after reasonable enquiries, or
  • Have a severe, long-term health condition or incapacity that permanently prevents them from caring for the child

It also applies in mixed situations — one parent has died, and the surviving parent is missing or totally incapacitated. The statutory basis is Sections 43–45 of the Social Security Act 2018.

When the Unsupported Child's Benefit Applies

The UCB covers situations where there's been a breakdown in the family relationship that prevents the parents from providing care or financial support. The parents are typically alive and locatable, but unable to care for the child due to:

  • Substance addiction
  • Imprisonment
  • Family violence
  • Mental health crisis
  • Abandonment

Work and Income assesses parental inability objectively — they're looking at whether the parents can care for the child, not making judgments about their behaviour. The statutory basis is Sections 46–48 of the Social Security Act 2018.

The Practical Difference: Parental Contact

The most significant practical difference is what happens with the parents during the application. For an OB application, parental contact is minimal or impossible — the evidence centres on death certificates, medical reports, or records of unsuccessful search attempts.

For UCB, Work and Income may contact the natural parents to verify the family breakdown. They need to confirm the parents aren't providing care or financial support. This step worries many caregivers, especially in volatile family situations. Two important protections:

  1. If contacting a parent poses safety risks (domestic violence, protection orders), MSD policy directs case managers to waive direct parental contact and rely on third-party evidence
  2. If a Family Group Conference has already happened and an outcome plan exists, this usually satisfies the assessment without further parental interviews

What About Child Support?

With UCB, Work and Income requires the caregiver to help identify and locate the natural parents so Inland Revenue can assess child support liabilities. Child support collected from the parents is retained by the Crown to offset the public cost of paying the UCB. If the amount collected exceeds the weekly UCB rate, the excess is passed through to you.

With OB, child support recovery usually doesn't arise because the parents are deceased, missing, or incapacitated.

Which One to Apply For

You don't need to agonise over this. Both benefits use the same application form — the M14. When you explain the parental circumstances, Work and Income determines which benefit applies. If you're unsure, call 0800 559 009 and describe the situation. The outcome for you as the caregiver is financially identical.
