Does Kinship-ND Trigger Child Support Enforcement in North Dakota?
Kinship-ND Does Not Trigger Child Support
One of the most common fears kinship caregivers have is that reaching out for help will automatically start a child support case against their adult child or the child's other parent. If the parent is struggling with addiction, incarceration, or mental health issues, that enforcement action can feel like a betrayal — and some caregivers avoid applying for benefits entirely because of it.
The answer depends on which program you apply for. Kinship-ND and TANF have very different rules.
Kinship-ND: No Child Support Requirement
Applying for Kinship-ND — North Dakota's kinship navigation and financial support program — does not trigger child support enforcement. Kinship-ND does not require opening a child welfare case, does not automatically initiate a child protection investigation, and does not refer the case to the Child Support Division.
This applies to all Kinship-ND services: the $800 expense reimbursement, the $2,500 guardianship legal fund, and navigation support. You can submit Form SFN 408 to Kinship-ND and receive help without the parents ever being contacted about support payments.
TANF Child-Only: Child Support Cooperation Is Required
If you apply for child-only TANF cash assistance, the rules change. TANF program rules require the caregiver to cooperate with the North Dakota Child Support Division to establish paternity (if needed) and pursue medical and financial support from the child's non-custodial parents.
This cooperation requirement is a condition of receiving TANF. If you refuse to cooperate without a recognized exception, your TANF application can be denied or your benefits reduced.

The Good Cause Exception
North Dakota recognizes a "good cause" exception to TANF's child support cooperation requirement. You can claim good cause if cooperating would:
- Put you, the child, or the parent at risk of physical or emotional harm
- Interfere with family reunification efforts managed by child protection services
- Disrupt child-protection service objectives
To file a Good Cause Claim, request the form at your local Human Service Zone office during the TANF application process. Child support enforcement actions are suspended while the Zone reviews your supporting documentation — which can include protective orders, police reports, medical evaluations, or a written statement explaining the risk.
If good cause is approved, you receive TANF benefits without a child support referral for the parent or parents covered by the claim. Child support activity may not continue while the approved good-cause determination remains in place.
Practical Strategy for Kinship Caregivers
Many caregivers are uncomfortable with the child support requirement attached to TANF. If that describes your situation, consider this approach:
- Apply for Kinship-ND first — no child support strings attached. Secure the $800 expense reimbursement and navigation services.
- Apply for Medicaid using Form SFN 1909 — North Dakota's child-support cooperation rule applies to legally responsible caretaker relatives, while children in the Medicaid household remain eligible even if a caretaker relative is found not to cooperate.
- When ready for TANF, file the Good Cause Claim alongside your application if enforcement would cause harm.
The good cause process is not a loophole — it is a legally recognized protection built into TANF policy. Caseworkers at your Human Service Zone handle these requests regularly.
What About SNAP?
SNAP does not have a child support cooperation requirement. You can apply for food assistance without any impact on child support status.
