McKinney-Vento School Enrollment for Grandparents in New York

Your grandchild moved in because the parent lost housing, entered treatment, or could not provide a stable home. The school wants paperwork you do not have — no birth certificate, no immunization records, no proof of residency in the district. The McKinney-Vento Homeless Assistance Act may apply if the child lacks a fixed, regular, and adequate nighttime residence because of housing loss, economic hardship, family disruption, or a similar crisis.

Who Qualifies

Under 42 U.S.C. § 11431, a child qualifies as homeless when they lack a "fixed, regular, and adequate nighttime residence." In kinship care, that can include children who are:

  • Living with a grandparent or relative because they lost their prior home and have no fixed, regular, and adequate alternative residence
  • Sharing housing with relatives due to economic hardship or family crisis, without another fixed, regular, and adequate nighttime residence
  • Doubled up in a relative's home after a parent's incarceration, hospitalization, or death when that leaves the child without a fixed, regular, and adequate nighttime residence
  • Staying with family while a parent is in substance use treatment when that arrangement leaves the child without a fixed, regular, and adequate nighttime residence

The child does not need to be sleeping on the street. A temporary arrangement with a relative because of housing loss, economic hardship, family disruption, or a similar crisis can qualify if the child lacks a fixed, regular, and adequate nighttime residence. Your own home can be stable.

What the School Must Do

McKinney-Vento enrollment is immediate. The school district must:

  • Enroll the child the same day, without waiting for documents
  • Not require a birth certificate, immunization records, school transcripts, proof of residency, or proof of guardianship as a condition of enrollment
  • Assign a McKinney-Vento liaison who will help you obtain missing records after enrollment
  • Provide transportation to the child's school of origin if the child was attending a different school before moving to your home
  • Not segregate the child into a separate program based on their housing status

The district's McKinney-Vento liaison is your point of contact. Every district must have one. If you do not know who the liaison is, call the district office and ask, or contact NYS-TEACHS (the Technical and Education Assistance Center for Homeless Students) for a directory.

McKinney-Vento vs. Standard Enrollment

If your grandchild qualifies under McKinney-Vento, use it — it is faster and requires less paperwork. You can pursue OCFS-4940 or a residency affidavit in parallel to establish ongoing educational and medical authority, but do not let missing forms delay the first day of school.

If the child obtains permanent housing during the school year, McKinney-Vento services continue for the remainder of that academic year. The child may remain at the same school for that period if that is the selected school of origin; later enrollment follows the applicable residency rules.

Disputes

If a school district challenges a child's McKinney-Vento eligibility, the child must remain enrolled pending resolution. The district must refer the dispute to its McKinney-Vento liaison and provide a written explanation of its decision. You can appeal through the district and then to the state. NYS-TEACHS provides free dispute resolution assistance.

The New York School & Medical Consent Guide covers both the McKinney-Vento path and the standard enrollment path so you can use whichever applies — and switch between them as your situation changes.
