New York Guardianship Background Check and OCFS-3909 Form

Two Separate Background Checks, Not One

New York requires two distinct background screenings for proposed guardians, nonparent custody petitioners, and adult household members over 18. They run through different state agencies, and the court reviews the results as part of its child-safety and fitness assessment.

Statewide Central Register (SCR) clearance — Administered by the Office of Children and Family Services. This check searches the state's child abuse and maltreatment registry for an "indicated" report involving the proposed guardian or an adult household member.

Division of Criminal Justice Services (DCJS) fingerprinting — A criminal history record check through New York's criminal justice database. The court reviews felony and misdemeanor convictions, paying particular attention to offenses involving violence, drugs, or crimes against children.

Both checks cover the proposed guardian and every adult over 18 living in the household. A spouse, adult child, or roommate who will share the home with the child must also be screened.

The OCFS-3909 Form

Form OCFS-3909 is used for the Statewide Central Register check. Follow the current form and court instructions for the information and authorization required.

The form is typically included in the filing packet when you submit your guardianship petition (Form 6-1) to the Family Court clerk. Use the current official instructions to confirm which identifying fields and authorizations are required for each person being screened.

The screening results go directly to the court and remain confidential. The judge reviews them as part of the child-safety and petitioner-fitness assessment.

What Happens If Something Shows Up

The court reviews SCR and criminal-history results in the context of the petition as part of its child-safety and petitioner-fitness assessment.

The court's review is focused on the child's safety and the proposed guardian's fitness.

If another adult household member has a record, ask the court or a lawyer how the required household screening applies before relying on a change in living arrangements.

How Long the Checks Take

The court may adjourn the case to allow agency processing of background checks. Ask the clerk about current processing status rather than relying on a fixed number of weeks.

If a child needs interim legal authority while the case is pending, a caregiver can request temporary relief. An ex parte request specifically requires immediate, irreparable harm or a threat to the child's life or health.

This Is Not a Foster Care Home Study

A guardianship or custody background check is a judicial screening tool. It is distinct from the licensing and certification process required for foster care homes, and is focused on child safety and petitioner fitness.

The Court Process Guide covers background checks in detail, including what to expect, how to prepare, and what to do if a result raises questions with the court.
