New Hampshire Caregiver Authorization Affidavit: What Actually Exists

The Form That Doesn't Exist

If you search for "New Hampshire caregiver authorization affidavit," you'll find commercial form sites happy to sell you one. The problem: New Hampshire has never enacted a statutory caregiver authorization affidavit law. That generic form you just paid $39.95 for carries no statutory weight when you hand it to a school registrar or pediatrician.

States like California and Massachusetts have specific caregiver affidavit statutes that require institutions to accept a properly executed form. New Hampshire doesn't. House Bill 1377, introduced in the 2026 session, proposed creating a statutory caregiver authorization affidavit framework under RSA 461-C — but it died when the session ended. It never became law.

What New Hampshire Actually Offers

Instead of a single affidavit form, New Hampshire caregivers navigate a system of layered authorization instruments, each with different legal weight:

RSA 461-A:19-a Temporary Agent — The closest statutory equivalent. A parent or guardian can delegate care, custody, or property powers for up to 60 days, subject to the other-parent, parenting-plan, court-placement, and child-protection restrictions in subsection III. The writing must be signed by or at the direction of the parent or guardian, attested by two adult witnesses (neither being the agent), and accepted by the agent in writing. This carries statutory authority but only lasts 60 days.

Parental delegation letters — An informal written instrument where a parent specifies what authority they're delegating to a relative. These are legally revocable at any time and accepted at the receiving institution's discretion. Many pediatric offices and schools have their own forms that serve a similar purpose.

Provider-specific institutional forms — Hospitals, clinics, and school districts often have internal forms allowing a parent to designate a secondary adult for consent. These work within that specific institution only.

RSA 463 guardianship — A court order granting legal authority over the minor's person, estate, or both, subject to statutory and court-order limits. The most powerful instrument, but requires filing a petition, a court hearing, and usually a waiting period.

Why Generic Forms Get Rejected

The commercial "caregiver authorization affidavit" forms sold online for New Hampshire typically borrow language from states that have statutory affidavit acts. When a school administrator or clinic receptionist looks up the cited statute and finds it doesn't exist in New Hampshire law, the form goes straight into the rejection pile.

Worse, some forms cite RSA 546-A (Uniform Civil Liability for Support), which governs financial support obligations between family members. It has nothing to do with delegating custody, educational rights, or medical consent authority.

What to Use Instead

For most kinship caregivers, the practical approach depends on whether the parent is cooperative:

Parent willing to sign: If RSA 461-A:19-a, III allows the appointment, execute a temporary agent appointment with the required witnesses and acceptance, plus institution-specific forms for the child's school and medical providers. Re-execute before the 60-day expiration.

Parent unable or unwilling to sign: File a guardianship petition under RSA 463. The filing itself unlocks school enrollment under RSA 193:12, II(a)(3) — the district must enroll the child while the petition is pending.

Emergency situations: An ex parte petition under RSA 463:7 may result in an immediate order if the court grants the requested relief, though it expires in 30 days unless extended under the statute.
