Arizona Caregiver Authorization Affidavit: Why It Doesn't Exist

The Form That Doesn't Exist in Arizona

If you searched for an Arizona caregiver authorization affidavit, you've probably seen commercial legal form sites selling one. The problem: Arizona does not have a caregiver authorization affidavit statute. The forms being sold under that name have no legal authority in this state.

California has a specific Caregiver's Authorization Affidavit (Family Code § 6550) that allows a relative to sign a single document — without the parent's signature — to enroll a child in school and consent to medical care. Several other states have similar laws. Arizona is not one of them.

What Gets Sold Instead

Sites like US Legal Forms market an "Arizona Caregiver's Authorization Affidavit — Minor Children" template. These are generic national templates adapted with Arizona branding. When you bring one to an Arizona school registrar or pediatrician's office, they have no obligation to accept it, because it doesn't correspond to any recognized legal instrument under Arizona law.

Worse, some caregivers present these affidavits thinking they have medical consent authority, only to be turned away at a clinic when the child needs to be seen. An Etsy template labeled "Arizona Grandparent Medical Consent Form" has the same problem — it's a piece of paper with no statutory backing.

What Arizona Actually Recognizes

Arizona gives kinship caregivers two legitimate paths for authority over a child:

Parental Power of Attorney (Form GNPPOA10F) under A.R.S. § 14-5104. The parent signs this before a notary and one witness, delegating care, custody, and property decisions to you for up to six months. This is the standard tool for school enrollment, medical consent, and daily decision-making. But it requires the parent's signature — you can't execute it alone.

Court-ordered guardianship under A.R.S. § 14-5207 (temporary) or § 14-5204 (permanent). A Superior Court judge grants you legal authority. This is the route when the parent is unable or unwilling to sign a POA.

For school enrollment specifically, the ADE Affidavit of Shared Residence proves the child lives at your address. Combined with a POA, it covers what the nonexistent "caregiver authorization affidavit" would have covered if Arizona had one.

If You Already Bought a Template

It's not worthless, but it's not a legally recognized Arizona instrument. Institutions are not required to accept it; some may accept it informally, but you should not rely on that for school or medical authority.

The better investment is getting the parent to sign Form GNPPOA10F. The form is available free from the Maricopa County Superior Court website. The only cost is notarization.

Our Arizona School & Medical Consent Guide explains every legally recognized instrument in Arizona, which ones require a parent's signature, and what to do when the parent isn't available.
