Missouri Guardianship and Benefits: TANF, Medicaid, and MO HealthNet After a Court Order

One of the most immediate questions after a Missouri guardianship order is signed: what financial help is available for the child? The answer depends on which programs you apply for and how the child's eligibility is calculated — and guardianship changes the math in your favor for several key benefits.

TANF Child-Only Grants

Missouri's Temporary Assistance (TA) program, administered by the DSS Family Support Division (FSD), can include a child without including the non-parent caretaker's own needs and income. FSD policy allows a needy non-parent caretaker relative or legal guardian to be excluded from the assistance group; if the caretaker is included, their needs, income, and resources count.

This means a guardian may be able to apply for the child without being included in the grant group. You apply through the Family Support Division, and you must cooperate with FSD's child support enforcement efforts unless FSD finds good cause for not cooperating.

Having Letters of Guardianship simplifies the application because it establishes your legal relationship to the child. Without a court order, you may need to provide additional documentation to prove the child is in your care.

MO HealthNet (Medicaid and CHIP)

Children in a relative guardianship can apply for MO HealthNet for Kids, Missouri's Medicaid and CHIP program, but guardianship alone does not establish eligibility. DSS applies household-composition and income rules to determine whose income counts. In some cases, the child and caretaker relative have separate household sizes; in others, a tax household affects which people are counted.

Apply through the DSS Family Support Division or online at mydss.mo.gov. If the child was already covered under a parent's MO HealthNet case, you may need to update the case to reflect the guardianship. Ask each program what proof it needs.

SNAP (Food Stamps)

SNAP eligibility evaluates total household composition and household income — unlike TANF child-only grants, your income does count here. You include the child in your household SNAP application through FSD.

If you are already receiving SNAP benefits, adding the child to your household may increase your benefit amount because the household size increases. Report the change to FSD within the required timeframe to avoid overpayment or underpayment issues.

What Guardianship Does Not Unlock: State Subsidized Guardianship

There is a critical distinction many caregivers miss. Missouri's Subsidized Guardianship Program under RSMo § 453.072 provides assistance for eligible children, but eligibility is not limited to children who were in DSS Children's Division custody immediately before guardianship. DSS policy also recognizes other agency placements, with additional special-needs requirements for some non-Children's Division cases. The subsidy agreement must be approved before the guardianship is awarded.

If you filed a private probate guardianship under RSMo Chapter 475, that petition alone does not establish eligibility for subsidized guardianship. Check the child's status and the applicable DSS criteria with the caseworker before finalizing. Temporary Assistance may be another option; its grant group follows the rules described above.

Applying After Your Order Is Entered

For Temporary Assistance, FSD requires documentation of a court-appointed guardian's status. Have your court appointment documents available, and ask the other programs what proof they require.

If you are already receiving benefits for the child through an informal arrangement and now have a guardianship order, update your case with FSD. The guardianship may streamline future renewals and eliminate questions about your authority to act on the child's behalf.

The Bigger Picture

Navigating benefits is just one piece of post-guardianship life. The Missouri Guardianship and Custody Court Process Guide includes a benefits application tracker and post-order compliance calendar that helps you manage benefit renewals alongside any reporting obligations imposed by your court order.
