McKinney-Vento Act and Grandparent Caregivers in Massachusetts
What McKinney-Vento Means for Kinship Families
The McKinney-Vento Homeless Assistance Act is a federal law that protects children who lack a fixed, regular, and adequate nighttime residence. When a child moves into a grandparent's or relative's home because of a loss of housing, economic hardship, or a similar reason, the child may qualify as "homeless" under the Act — even though they now have a roof over their head. Domestic violence, a parent's rehab stay, or incarceration may be part of the circumstances, but those events alone do not establish eligibility; the housing arrangement must meet the Act's definition.
The federal definition of "doubled-up" covers children sharing another household because of loss of housing, economic hardship, or a similar reason. A parent's rehab stay or arrest, by itself, does not make the child qualify; the reason for and stability of the housing arrangement matter.
The Rights McKinney-Vento Triggers
Once a child qualifies, the school district must:
- Enroll the child immediately, even without standard residency proof, birth certificates, prior school records, or immunization documentation
- Let the child stay in their school of origin if that is in the child's best interest, and provide transportation to get there
- Not delay enrollment while gathering missing records — the district must help obtain them after the child is in school
These rights are powerful. A Caregiver Authorization Affidavit under M.G.L. c. 201F is not required for McKinney-Vento enrollment. If the child qualifies, the school cannot demand one before letting the child attend.
How to Activate McKinney-Vento Protections
Every Massachusetts school district has a designated Homeless Education Liaison. This is the person to contact. Explain the circumstances that brought the child to your home, and ask for a McKinney-Vento eligibility determination.
You do not need to be sleeping outside. A child sharing housing because of loss of housing, economic hardship, or a similar reason may qualify under the "doubled-up" category. The liaison assesses the child's housing circumstances and the reason for the arrangement; caregiver income alone is not the test.

McKinney-Vento and the Caregiver Affidavit Are Separate Tools
McKinney-Vento gets the child into school fast. The Caregiver Authorization Affidavit gives you ongoing authority to sign permission slips, access records, attend IEP meetings, and consent to medical care. They solve different problems, and you may need both.
A common scenario: a child arrives at your home suddenly. McKinney-Vento ensures immediate enrollment while you work on getting the parent to sign the affidavit. Once the affidavit is executed, you have a stable two-year document for all school and medical decisions.
If no parent, legal guardian, or legal custodian with authority can or will sign the affidavit, McKinney-Vento may provide an enrollment path if the child qualifies — but it does not grant medical consent authority. For ongoing medical decisions without a signed affidavit, you would likely need to pursue court guardianship.
Emergency Medical Situations
If the child needs emergency care, seek emergency help immediately and give the care team the information you have. For routine and scheduled care, the caregiver affidavit is the statutory tool for consent; without it, non-parent caregivers may face consent barriers.
The Massachusetts School and Medical Consent Guide walks through both pathways — McKinney-Vento for immediate school access and the caregiver affidavit for ongoing authority — with specific guidance for the common situation where a child arrives before any paperwork is in place.
