McKinney-Vento Act and Kinship School Enrollment in West Virginia

What McKinney-Vento Means for Kinship Families

The McKinney-Vento Homeless Assistance Act is a federal law that guarantees certain educational rights to children experiencing housing instability. For kinship caregivers in West Virginia, it can be the fastest way to get a child enrolled in school — even without a birth certificate, immunization records, or proof of residency — when the child's living situation qualifies.

The key point that many caregivers miss: kinship care alone does not automatically trigger McKinney-Vento protections. The child must be experiencing actual housing instability, not simply living with a relative instead of a parent.

Who Qualifies

Under McKinney-Vento, a child is considered homeless when they lack a fixed, regular, and adequate nighttime residence. The most common kinship scenario that qualifies is doubled-up housing — when the child and caregiver are sharing someone else's home because of loss of housing, economic hardship, or a similar reason.

Examples that typically qualify:

  • A grandparent takes in a grandchild after the parent's eviction, and they are both living in the grandparent's small apartment because neither has another option
  • A child moves in with an aunt's family after a parent enters rehab, and the aunt's household is already over capacity
  • A relative takes in a child after a parent's death, and the child is sharing housing because of the resulting loss of housing or a similar hardship and lacks a fixed, regular, and adequate nighttime residence

Examples that typically do not qualify:

  • A grandparent in a stable home takes in a grandchild as a long-term arrangement — the child has a fixed, regular residence
  • A family voluntarily places a child with a relative for school-district reasons

The determination is made by the school district, often with input from the McKinney-Vento liaison.

What the Law Requires

When a child qualifies, the school district must provide:

Immediate enrollment. The school must enroll the child right away, even without normally required documents — birth certificates, immunization records, proof of residency, or guardianship papers. The school cannot delay enrollment while waiting for records.

School of origin rights. The child can choose to remain enrolled in their school of origin (the school they attended when they were last permanently housed, or the school they most recently attended) if it is in their best interest. The district must provide transportation to the school of origin.

Dispute resolution. If the district challenges the child's eligibility or enrollment, they must immediately enroll the child pending formal resolution and provide a written explanation of the right to appeal.

The McKinney-Vento Liaison

Every county school district in West Virginia is required to designate a McKinney-Vento liaison — a staff member responsible for identifying eligible students, ensuring enrollment, connecting families with services, and resolving disputes. If you believe a child in your care qualifies, the liaison is your first contact.

You can find your county's liaison through the district's central office or the West Virginia Department of Education. If you are not sure whether the child qualifies, ask the liaison — they make the eligibility determination.

How This Connects to Kinship Consent Documents

McKinney-Vento removes the enrollment barrier, but it does not address medical consent or ongoing school authority. For a child not placed in the custody of the Department of Human Services under Chapter 49 proceedings, you may need a legal instrument for healthcare — the Caregiver Consent Affidavit (§49-2-703) or a Power of Attorney (§49-8-4). You may also want a county relative caregiver affidavit on file for school records and communications going forward.

Think of McKinney-Vento as the emergency door: it gets the child into school immediately. The consent documents are the long-term structure that keeps everything running.
