Jackson County Missouri Guardianship of a Minor: Probate Court Filing Guide
If you are filing for guardianship of a minor child in the Kansas City area, your case goes through the Jackson County Circuit Court — specifically the probate division of the 16th Judicial Circuit. Jackson County has its own forms, its own fee schedule, and its own service requirements that differ from other Missouri circuits.
Where to File
Minor guardianship petitions in Jackson County are filed with the Probate Division of the 16th Judicial Circuit. The courthouse that handles probate matters is at the Jackson County Courthouse in Kansas City (415 E. 12th Street). You can also check with the Independence courthouse if you live in eastern Jackson County.
Venue in Missouri is determined by the child's domicile under RSMo § 475.035. For a minor, domicile is that of the custodial parent, custodial parents, or guardian.
The Jackson County Probate Packet
Jackson County maintains its own probate filing forms. For a minor guardianship, the key forms include:
- Petition for Appointment of Guardian of a Minor — identifies the child, the parents, and the reason guardianship is needed under RSMo § 475.060
- Information Regarding Proposed Ward (Form 10320a) — local exhibit form detailing the child's residence history, existing court orders, and assets
- Parental Consent/Waiver forms — if a parent agrees to the appointment and waives service
- Minor's Selection Form — if the child is over 14 and has no qualified parent living, RSMo § 475.045.1(2) gives preference to a person the minor nominates
Jackson County requires proof of timely notice by mail: file the signed certified-mail return receipt or, for ordinary mail, the Certificate of Mailing no later than seven days before the hearing. In cases served by summons, the court also requires the Notice of Hearing to be mailed and the Certificate of Mailing filed at least seven days before the hearing.
Filing Fees and Fee Waivers
Jackson County's posted filing fee for a minor guardianship is $100.50 and does not include service. The 16th Circuit's January 2026 checklist lists a $46.00 fee per person served by Jackson County Civil Process. Private process-server charges are separate, and the judge may require a deposit if a Guardian ad Litem (GAL) is appointed.
Under RSMo § 514.040, a court may allow a qualifying petitioner to proceed without the fees and charges it determines the person cannot pay. The court's order controls whether filing, service, publication, or private Guardian ad Litem costs are waived.

Background Checks
The 16th Circuit's January 2026 minor-guardianship checklist requires a background screening of the nominated guardian under RSMo § 475.050.4, unless the nominee is the minor's spouse, parent, or adult sibling. The checklist identifies the FCSR as one resource for obtaining screening information. The screening results are due at least ten days before the appointment hearing under § 475.050.4, unless the court waives or modifies the deadline for good cause shown by an affidavit filed with the petition or the protected person requests an expedited hearing. The checklist does not list a separate fingerprint check or screening of all adult household members; RSMo § 43.548 permits circuit courts to require fingerprint-based criminal-history checks of applicants for guardianship over minors.
Pro Se Filing in Jackson County
Jackson County does not accept pro se applications for minor guardianship. The 16th Circuit's 2026 Notice to Pro Se Litigants lists all applications for Letters of Guardianship and/or Conservatorship of a Minor among matters that require an attorney. Under the circuit's probate procedure manual, the court appoints a GAL when a natural parent contests the petition, unless the case is transferred to Family Court.
If a juvenile case involving the same child is pending in Jackson County, the probate division's minor guardianship checklist asks for consent from a family court judicial officer before proceeding. This is specific to Jackson County and reflects the juvenile court's paramount jurisdiction under RSMo § 211.031.
Service and Notice
Parents must receive notice unless they signed the petition or waived notice under RSMo § 475.070. Jackson County follows these service methods:
- In-state personal service by the county sheriff or a court-appointed special process server
- Out-of-state service by registered or certified mail when authorized under RSMo § 506.160.2, or by an officer authorized to serve process in the state where service is made under § 506.160.6.
- Service by publication if a parent cannot be found — requires filing an Affidavit of Diligent Search first, then four consecutive weeks of publication in a court-approved newspaper
If both parents consent and sign waivers of service, the hearing process is faster. But even with consent, the court must still find that the parents are unfit, unwilling, or unable to assume care under RSMo § 475.030.
