How Legal Status Affects Kinship Benefits in Indiana

One of the first questions kinship caregivers ask is whether they need to go to court before they can get help. The answer depends on which benefits you're pursuing — and getting the wrong legal arrangement at the wrong time can actually cost you money.

Informal Care (No Court Order, No Documents)

You can apply for Child-Only TANF, SNAP, and Hoosier Healthwise without any court order. DFR accepts informal kinship arrangements — a grandparent or relative who has physical custody of the child can file as the child's representative. Proof of the living arrangement (school records, medical records, or self-attestation) is enough to get the application started.

What you can access: Child-Only TANF, SNAP, Hoosier Healthwise, WIC (if the child is under 5), school meal programs, and CCDF childcare vouchers.

What you cannot access: DCS stipends, KinGAP payments, or any program that requires a formal placement or court order.

Power of Attorney (IC 29-3-9-1)

A parent can sign a power of attorney delegating care, custody, and property authority over a minor to you for up to 12 months (longer if the parent is deployed military). No court filing needed.

A POA doesn't change your benefit eligibility. You qualify for the same DFR programs as with informal care. The advantage is that a POA gives you documented authority for medical decisions, school enrollment, and other situations where institutions want something on paper.

Your income stays excluded from Child-Only TANF under a POA. For SNAP, your income counts if you share meals with the child — same as informal care.

Minor Guardianship (Court Order)

A court-appointed guardianship under IC 29-3-5 gives you legal authority over the child. Your income is still excluded from Child-Only TANF — DFR treats you as a non-needy relative caretaker regardless of whether you have guardianship or not.

For SNAP, guardianship doesn't change the household rules. If you live together and share meals, your income counts.

Guardianship does affect one important benefit: if the child was a DCS ward and you followed the full KinGAP pathway (licensed foster parent, 6 months of care, agreement signed before the order), guardianship triggers KinGAP payments. But a private guardianship obtained outside the DCS system doesn't qualify for KinGAP.

Custody Order (Family Court)

A custody order under IC 31-17-2-3 gives you legal custodian status. For benefit purposes, it works similarly to guardianship — Child-Only TANF still excludes your income, and SNAP still counts you if you share meals.

One difference: when you have a custody order and apply for TANF, child support payments are assigned to the state. That's the same requirement as any TANF case, but it's worth noting if the child currently receives child support directly.

DCS Placement (CHINS)

This is the arrangement with the most benefits — and the least control over when it happens. If DCS removes the child from the parents through a court proceeding and places the child with you, you're in the child welfare system.

Unlicensed relatives receive a $300 monthly stipend, up to $300 per year in personal allowances, initial clothing and bedding, and a childcare allowance of up to $18 per day. If you become a licensed foster parent and maintain the placement for six consecutive months, you may be eligible for KinGAP when you take guardianship.

The child also receives automatic Medicaid coverage through DCS — no separate application needed.

The Timing Trap

The biggest risk is pursuing guardianship too early in the DCS process. If you're on the KinGAP track (DCS ward, licensed placement, working toward guardianship), the financial agreement must be signed before the court enters the guardianship order. Getting the order first permanently closes the KinGAP door. If DCS is involved, talk to your Family Case Manager about the KinGAP timeline before scheduling any guardianship hearing.
