How Long Does Guardianship Take in California?
The Short Answer: Timing Depends on the Court and Investigation
California Courts says it takes at least a month, usually longer, for the court to decide a guardianship petition. The clerk sets the hearing date, and investigation timing depends on the county; ask your court or self-help center for its current schedule. Contested cases or service problems can require additional court dates.
What Determines the Timeline
Several factors affect how long the process takes, and most of the delays are things you can anticipate and manage.
Court scheduling. After you file the petition, the clerk assigns a hearing date. Ask your county court or self-help center how far out it is currently scheduling guardianship hearings.
Service of notice. Personal service on parents, the child if 12 or older, and others entitled to personal service is due at least 15 days before the hearing. Mail service is generally due at least 15 days before; allow 20 days for a recipient in another county, 25 days for someone out of state, and 35 days for someone outside the United States. File proofs of service at least 5 court days before the hearing. If a parent cannot be found, a due diligence search and court order on notice can delay the hearing.
Background checks. Complete Live Scan fingerprinting promptly when directed by the court or investigator. Processing and review timing depends on the county and the background-check process.
Court investigator scheduling. The investigator must schedule the home visit, conduct interviews, run checks, and write a report before the judge decides the petition. Ask the court about the current investigation queue in your county.
Probate notes deficiencies. If the court staff review reveals missing documents or service problems, the hearing may be continued to a later date set by the court.
Accelerating the Timeline: Temporary Guardianship
If you need legal authority before the full hearing — for school enrollment, medical treatment, or benefits applications — you can file for temporary guardianship using form GC-110(P) with the general petition or in an existing guardianship case. The court sets an earlier hearing for the temporary request; the date depends on the county and the required notice.
The temporary order does not replace the full guardianship — it bridges the gap until the hearing.

| Investigator report filed with court | Before the hearing |
| Check probate notes for deficiencies | Check your county court's instructions for when notes are posted |

What Adds Time
Parent cannot be found. Due diligence searches and requests to waive notice or allow alternate service can delay the hearing; the court sets the schedule.
Parent objects. A contested hearing may be continued for evidence gathering, and the hearing itself is longer. Some contested cases require multiple hearing dates.
Background check issues. If a Live Scan result raises concerns (a prior arrest, for example), the investigator may need additional time to evaluate the circumstances.
Incomplete filing. Missing forms, unsigned documents, or incorrect service proofs get flagged in probate notes and lead to continuances.
The Emergency Exception
In a genuine emergency — the child is in immediate danger or the parent has been arrested and no one else is available — you can request temporary guardianship. The court decides whether an expedited or shortened-notice hearing is justified; unless the court orders otherwise, the temporary papers must be personally served at least 5 court days before the hearing.
