How Guardianship Changes Benefits in Washington
Many kinship caregivers wonder whether filing for guardianship will help or hurt their benefits. The answer depends on which program you're asking about and how the guardianship was established.
TANF Child-Only Cash: No Change
Whether you're caring for the child informally or hold a court-ordered guardianship under RCW 11.130, the TANF child-only grant works the same way. As a non-needy caretaker relative, your income is excluded. The grant amount depends on the number of children and the child's own income. Going from informal care to legal guardianship doesn't increase or decrease the TANF payment.
The one scenario where guardianship intersects with TANF differently: if the child entered your home through a DCYF dependency placement and you pursue guardianship through R-GAP, you may qualify for a negotiated GAP subsidy. Ask DCYF and DSHS how that affects any TANF benefits you receive.
Basic Food: Minor Impact
Basic Food household rules count everyone who lives together and shares meals. Becoming a legal guardian doesn't change the household composition calculation — you and the child were already in the same food unit. The one practical difference is documentation: a certified copy of Letters of Guardianship is stronger proof of the care arrangement than a relative caregiver declaration, which can simplify renewals.
Apple Health: Household Counting May Shift
Apple Health eligibility for children uses Modified Adjusted Gross Income (MAGI) rules. If you don't claim the child as a tax dependent, the child is evaluated as a 1-person tax household using only the child's own income — which almost always means free coverage (up to 215% FPL for $0 premiums).
If you become the child's legal guardian and then claim them as a tax dependent, the child may be counted in your tax household. For higher-income guardians, this could move the child into a premium tier ($20-$30/month) or, in rare cases, above the 317% FPL threshold. For most kinship caregivers on fixed incomes, the distinction is academic — the child qualifies either way.

Childcare Subsidies: Depends on the Pathway
Standard Working Connections Child Care (WCCC) eligibility doesn't change based on guardianship status. You still need to meet the activity requirement (working, training, or exempt) and the income threshold.
The exception is the child welfare pathway. If the child was in DCYF custody and you're transitioning to guardianship through R-GAP, you may qualify for up to 12 months of Child Welfare Continuing Child Care (CWCCC) — zero copays, no work requirement. This benefit is tied to the DCYF case closure, not the guardianship itself, and the referral must happen before the case closes.
Emergency Funds and Legal Support
Obtaining a guardianship doesn't disqualify you from KCSP emergency funds through your local Area Agency on Aging. In fact, KCSP can help pay guardianship filing fees — court costs, petition filing fees, and related expenses.
The Northwest Justice Project (NJP) offers free legal screening for low-income caregivers. Call CLEAR at 1-888-201-1014 (or 1-888-387-7111 for seniors 60+) to ask about help with a guardianship filing; screening does not guarantee representation.
The Decision Framework
Guardianship gives you legal authority to make all decisions for the child — medical, educational, and financial — without needing parental consent or a relative caregiver declaration. It doesn't significantly change most benefit amounts. The Washington Financial Help for Kinship Caregivers guide includes a side-by-side comparison of benefits by legal arrangement — informal care, private guardianship, and DCYF placement — so you can see exactly what changes and what stays the same.
