Hawaii Power of Attorney for a Minor Child: How It Works

A Parent-Signed Tool for Temporary Delegation

Hawaii's Minor Power of Attorney (HRS § 560:5-105) is a completely different instrument from the caregiver consent affidavits most kinship families use. The critical difference: only a parent or legal guardian can sign it. A grandparent, aunt, uncle, or family friend cannot create one on their own.

When it works, the POA is powerful. It delegates broad parental authority — care, custody, education, health decisions, and even property management for the child — all without involving Family Court.

The Strict One-Year Limit

HRS § 560:5-105 caps the delegation at 12 consecutive months. The time limit must be explicitly stated in the document. There is no automatic renewal — if the care arrangement continues past one year, the parent must execute a new POA.

This makes the Minor POA ideal for situations with a defined timeline: a parent entering a treatment program, taking a temporary work assignment on the mainland, dealing with a medical issue, or serving a short sentence.

Who Signs and How

The POA must be executed by a parent or guardian of the minor. It must be notarized. The caregiver (the person receiving the authority) does not need to sign — the delegation flows from the parent or guardian.

If a parent is incarcerated, the facility's social work staff can often facilitate the notarized signature inside the institution. This is one of the few ways an imprisoned parent can formally empower a relative to handle everything from school enrollment to medical emergencies while they serve their sentence.

What the POA Covers

The scope is broader than a caregiver affidavit:

  • All school decisions, including enrollment, academic records, and activity consent
  • All healthcare decisions (routine and otherwise)
  • Care and custody of the child day-to-day
  • Property management for the child's assets
  • Essentially any parental decision the parent could make themselves

This makes it useful when the caregiver affidavit isn't enough — for example, when a medical procedure falls outside the affidavit's routine care scope, or when an institution demands more than an affidavit provides.

What It Cannot Do

Two hard exclusions:

  • Consent to the child's marriage — the POA cannot delegate this
  • Consent to the child's adoption — this requires formal court proceedings regardless

The POA also does not create permanent legal custody. The parent retains all parental rights and can revoke the delegation at any time. If the parent shows up and says "I'm taking my child back," the POA doesn't give the caregiver a legal basis to refuse.

POA vs. Caregiver Affidavit: Choosing the Right One

Minor POA (HRS § 560:5-105) Caregiver Affidavits (HRS § 577-28 / § 302A-482)
Who signs Parent or legal guardian The caregiver
When the parent is available Yes — requires the parent's cooperation Works when the parent is absent or uncooperative
Duration Maximum 12 months Ongoing until parent rescinds in writing
Scope Broad — all parental authority Specific — school enrollment and routine health care
Notarization Required Required (medical); DOE form (educational)

If the parent is willing and available, the POA gives the caregiver the strongest possible authority short of a court order. If the parent isn't available, the caregiver affidavits are the path forward.

Our Hawaii School and Medical Consent Guide covers all three instruments — both affidavits and the Minor POA — with side-by-side instructions, document preparation checklists, and a decision framework for choosing the right one based on your family's situation.
