Illinois Power of Attorney for Minor Child
Two Instruments, Not One
When people search for "power of attorney for a minor child" in Illinois, they are usually looking for one of two things — and the distinction matters because each form covers different ground.
Written health-care delegation for a minor (755 ILCS 45/4-10) lets a parent delegate authority to consent to the child's medical care. The document must be executed by the parent and identify the agent and the agent's powers. The statutory short-form health-care POA under 755 ILCS 45/4-10 is for the principal's own care, not for this parent-to-caregiver delegation; the separate delegation does not have to follow the short form's witness or notary formalities. It covers health care only.
Appointment of Short-Term Guardian (755 ILCS 5/11-5.4) is broader. It delegates day-to-day care — medical consent, school enrollment, benefits applications, and routine daily decisions. It requires two adult witnesses (no notary required, though recommended). It lasts up to 365 days.
Many caregivers assume they need a "power of attorney" when what they actually need is the short-term guardianship, because the guardianship covers school and benefits in addition to health care.
When the Written Health-Care Delegation Makes Sense
The written health-care delegation is the right tool when:
- A parent is willing to delegate medical authority but not broader caregiving control
- The child already lives with the parent for school purposes, and only medical consent is needed (for example, a grandparent who takes the child to appointments while the parent works)
- The caregiver only needs health care authority and already has school enrollment handled through ISBE Form 85-51
The parent can revoke the delegation at any time.
Execution Rules
For a written health-care delegation under 755 ILCS 45/4-10: no witness or notary formalities are prescribed, but the parent must identify the agent and the agent's powers.
For the short-term guardianship: two adult witnesses, neither of whom is the person being appointed guardian. Notarization is optional under the statute but strongly recommended.
Both delegation options require voluntary execution by a parent or court-appointed guardian with authority to delegate the child's care. If the parent is incarcerated, IDOC facilities provide notary and witness services. If the parent is out of state, Illinois allows remote execution via real-time audio-video communication under the Electronic Estate Planning Documents and Remote Witnesses Act.
If no parent or court-appointed guardian with authority is willing or able to sign, neither document can be executed for the caregiver. The caregiver must rely on ISBE Form 85-51 for school enrollment (which does not require a parent signature) or petition for formal court guardianship under 755 ILCS 5/11-5.

Free Forms Are Available
Illinois Legal Aid Online (illinoislegalaid.org) provides a free form builder for the short-term guardianship and an adult health-care POA Easy Form. That POA form is for the principal's own care under 755 ILCS 45/4-10, not for a parent delegating health-care authority for a minor under that section. The Illinois Courts website publishes standardized statewide forms for the guardianship.
National form sites like Rocket Lawyer and US Legal Forms also offer Illinois templates, but check the details — some default to a six-month duration that does not match Illinois's 365-day statutory limit for the short-term guardianship.
For a side-by-side comparison of which form you need, plus checklists for school enrollment, medical consent, and tracking the expiry dates, the Illinois School and Medical Consent toolkit walks through the decision and the paperwork in sequence.
