Hawaii Caregiver Consent Form: Where to Get It and What You Actually Need

Two Forms, Two Sources

Hawaii's caregiver consent system uses two separate affidavits for two different purposes, and they come from two different places:

Educational Caregiver Consent Affidavit (HRS § 302A-482): The official form is designed and maintained by the Hawaii Department of Education. You can get it at any public school's administrative office — ask the SASA (School Administrative Services Assistant) or Vice Principal. The DOE provides this form under the statute.

Medical Caregiver Consent Affidavit (HRS § 577-28): Standardized forms and instruction packets are published by the Legal Aid Society of Hawaii (LASH). They're available at LASH's offices on every major island, at major medical centers, and at community health centers. LASH intake lines can also walk you through the preparation: Oahu (808-536-4302), Neighbor Islands (1-800-499-4302).

Hawaii doesn't maintain a single centralized website where you download both forms. That fragmentation is one of the biggest frustrations caregivers face.

What the Free Forms Include

The official forms cover the statutory requirements — they contain the affirmation fields the law requires, the signature blocks, and the notarization section. They are legally binding when properly executed.

What they typically don't include:

  • Step-by-step preparation instructions tailored to someone who's never done this before
  • A parent contact attempt log for when the parent can't sign
  • An escalation script for when a school or clinic refuses the form
  • A side-by-side comparison of the medical affidavit, educational affidavit, and Minor Power of Attorney
  • A document readiness checklist for what else you need at the school office or clinic
  • Guidance on the limits — what the affidavit doesn't cover, and when you need something stronger

The forms tell you what to fill in. They don't tell you how to navigate the system that's supposed to accept them.

Online Templates: Be Careful

A search for "Hawaii caregiver consent form" turns up legal document platforms like LegalZoom, Rocket Lawyer, and template sellers on Etsy and Gumroad. These range from roughly $1 to $60 and vary wildly in quality.

Common problems with generic templates:

  • Blending POA with affidavit — some list "temporary guardianship" or "power of attorney" when what you actually need is the caregiver consent affidavit. These are legally distinct instruments in Hawaii.
  • Requiring a parent signature with no exception path — if the parent could sign, you might not need the affidavit at all. The whole point of HRS § 577-28 and HRS § 302A-482 is that caregivers can execute these without a parent.
  • Missing mandatory elements — the anti-school-hopping affirmation required by HRS § 302A-482, or the statutory immunity acknowledgment under HRS § 577-28(d)
  • No Hawaii-specific statutory references — generic 50-state forms that don't cite the actual Hawaii statutes providers need to see

A form that's technically wrong doesn't just waste your money — it can get rejected at the school or clinic, delaying the child's access to the care they need.

The Notarization Step

Both the medical and educational affidavits must be notarized. You cannot download a form, fill it in at home, and show up at school with it. You need to sign the document in the physical presence of a Hawaii-commissioned notary public.

Notary services are available at most bank branches, credit unions, private shipping and mail centers, and court self-help offices. Budget $5–$15 per notarized signature. Bring your government-issued photo ID.

Keep the original notarized document. Provide certified copies to schools and healthcare providers.

Getting Everything in One Place

The free official forms give you the legally required documents. They're the starting point, and they're free. If all you need is the affidavit form itself and you're comfortable navigating the system on your own, start at your local school office (for education) or Legal Aid Society office (for medical).

Our Hawaii School and Medical Consent Guide bundles the complete process — both affidavits, the Minor POA, preparation checklists, the parent contact attempt log, escalation scripts, and the full enrollment and medical intake workflow — into one organized package for caregivers who want to walk into the school or clinic fully prepared.
