How Much Does Guardianship Cost in New York?

The Short Answer: It Depends on Your Path

Guardianship costs in New York range from essentially free (if you file pro se in Family Court with cooperating parents) to $10,000 or more (if you hire an attorney for a contested case in a complex jurisdiction). Where you fall on that spectrum depends on three things: which court you file in, whether the case is agreed or contested, and whether you hire a lawyer.

Here's the breakdown.

Court Filing Fees

Family Court: $0. There is no filing fee for custody or guardianship petitions in New York Family Court. No index number fee, no motion charges. This is one of the main reasons most kinship caregivers file in Family Court rather than Surrogate's Court.

Surrogate's Court: $20 for person-only guardianship. Under SCPA § 2402(8)(a), a petition for guardianship of the person costs a flat $20. If the guardianship includes the child's property, fees follow a tiered schedule based on the value of the estate — $45 for estates under $10,000, scaling up to $1,250 for estates of $500,000 or more.

Certified copies. You'll need certified copies of your guardianship order or Letters of Guardianship for schools, doctors, and benefits offices. In Surrogate's Court, each certified copy costs $6. Family Court fees for certified copies vary by county.

Process Server Costs

If the parents don't sign a waiver of service (Form 6-4), you'll need to hire a process server to personally deliver the petition to each respondent parent. Process server fees in New York typically range from $50 to $150 per service attempt, depending on the location and number of attempts needed.

In New York City, process servers charge higher rates due to travel time and building access challenges. Upstate, a single-attempt service may be as low as $40–$75.

If the parent can't be located and the court orders service by publication, newspaper publication costs range from $100 to $500 depending on the newspaper and number of required insertions.

Attorney Fees

This is where costs diverge dramatically:

Agreed cases. Some family law attorneys handle uncontested guardianship petitions for flat fees in the range of $1,500 to $3,000. This covers form preparation, filing, and representation at one or two court appearances. If both parents consent, the case is relatively straightforward.

Contested cases. When a parent opposes the petition, the case goes to a fact-finding hearing with witness testimony, cross-examination, and evidence presentation. Attorney fees for contested guardianship cases typically run $5,000 to $10,000 or more, billed hourly at $250 to $500 per hour depending on the attorney's experience and location.

Document preparation services. Independent paralegals and legal document preparation services offer a middle ground — they'll type and assemble your petition forms for $200 to $500. They're strictly prohibited from giving legal advice or representing you in court, but if you need help getting the paperwork right and plan to represent yourself at the hearing, it's an option.

Background Check Costs

The court will order Statewide Central Register (SCR) clearances and Division of Criminal Justice Services (DCJS) fingerprinting for you and all adults living in your household. The SCR check is processed through OCFS at no cost to the petitioner. DCJS fingerprinting fees are generally absorbed by the court or local DSS — check with your county clerk about any out-of-pocket costs.

Fee Waivers for Low-Income Petitioners

If you're filing in Surrogate's Court and can't afford the fees, you can apply for poor person relief under CPLR Article 11. You'll need to file an ex parte motion with a financial affidavit detailing your income, assets, and expenses. If granted, the court waives filing charges and certified copy fees.

The fee waiver does not cover third-party costs — process server fees, newspaper publication fees, or attorney fees remain your responsibility.
