How Much Does Guardianship Cost in California? Filing Fees, Attorney Costs, and Fee Waivers
The Three Cost Layers
Filing for guardianship of a minor in California involves three categories of expense. The total can range from zero (with a fee waiver) to several thousand dollars (with an attorney).
1. Court filing fee: usually $225 The fee for a guardianship of the person is $225 in most counties; a few counties charge $35 to $50 more. A petition for temporary guardianship (GC-110(P)) adds $60. A guardianship of the estate or of the person and estate has a $435 filing fee.
2. Court investigator fee: $400–$800+ Under Probate Code Section 1513.1, the court charges an investigation fee to cover the cost of the assigned court investigator who evaluates your home and makes a recommendation. The amount and billing process depend on the county.
3. Service and document costs: varies Personal service of the petition on parents requires a registered process server or sheriff — typically $50 to $150 per person served. Certified copies of Letters of Guardianship (GC-250) cost $25 to $50 per copy at the clerk's office. You will need multiple certified copies for schools, doctors, and benefits applications.
Attorney Costs
Hiring a private attorney for an uncontested guardianship in California typically costs $1,000 to $3,000. If the case is contested — a parent objects — attorney fees can run $3,000 to $5,000 or more, depending on the complexity of the hearing.
Many relatives file without an attorney. The Judicial Council forms are designed for self-represented petitioners, and county courthouse self-help centers offer free assistance with form completion. Legal Document Assistants (LDAs) — non-lawyers who type and file forms at your direction — charge $300 to $1,000 but cannot provide legal advice.
For low-income caregivers, legal aid organizations like Bet Tzedek (Los Angeles), Public Counsel, and the Alliance for Children's Rights offer free legal representation for qualifying guardianship cases. LawHelpCA (lawhelpca.org) is the statewide legal aid locator.
The Fee Waiver: FW-001-GC
This is the most misunderstood part of guardianship costs. Many caregivers assume they cannot afford to file because they see the filing fee and stop. But the fee waiver for guardianship cases works differently from ordinary civil fee waivers.
Under California Rules of Court, Rule 7.5, eligibility for a fee waiver in a guardianship proceeding is based on the child's financial means, not the petitioner's income or assets.
The child qualifies for a full fee waiver if:
- The child receives public benefits (Medi-Cal, CalFresh, SSI, CalWORKs)
- The child's household income is below state poverty thresholds
- The child cannot pay the fees after covering basic living needs
File form FW-001-GC (Request to Waive Court Fees — Ward or Conservatee) along with your petition. If the court grants the waiver, you receive FW-003-GC, which covers:
- The guardianship filing fee
- The temporary guardianship filing fee ($60)
- Court investigator fees
- Sheriff service fees
- Certified copy charges
- Telephone appearance costs
The court decides eligibility based on the child's financial means; filing a request does not guarantee that the court will grant it.

What a Fee Waiver Does Not Cover
The fee waiver does not cover private process server fees (you can use the sheriff instead, which the waiver does cover), attorney fees if you hire one, or costs like transportation to court. It covers court-imposed charges, not private expenses.
