Florida Guardianship Assistance Program (GAP): Requirements, Payments, and Extended Benefits

What GAP Provides

The Guardianship Assistance Program gives Florida kinship families a permanent exit from the foster care system without terminating parental rights. When it works, the dependent child moves from temporary placement into permanent guardianship with a relative — and the financial support follows.

The baseline monthly payment is $333 per child. But the amount is negotiable. The Guardianship Assistance Agreement (GAA) is a contract between the caregiver, the Community-Based Care lead agency, and DCF. If the child has physical, emotional, or developmental needs that justify higher support, you can negotiate a monthly rate up to whatever the child's licensed foster care board rate would have been.

Beyond the monthly stipend, GAP provides:

  • Full Medicaid coverage through age 18 (or 21 under Extended GAP)
  • A one-time reimbursement of up to $2,000 for legal, court, and administrative costs tied to obtaining guardianship
  • Florida public university tuition fee waivers for eligible youth

The Three Requirements That Cannot Be Skipped

GAP eligibility rests on a strict sequence. Miss one step and the funding is permanently lost.

1. Chapter 39 dependency adjudication. The child must be formally adjudicated dependent — removed by DCF due to abuse, neglect, or abandonment. Private guardianships under Chapter 744 or temporary custody under Chapter 751 do not count.

2. Six consecutive months of licensed foster care. You must hold a Level 1 Child-Specific Foster Home License and receive foster care board payments for the child for at least six straight months. Standard RCP payments without licensure do not satisfy this requirement.

3. The GAA must be signed before the case closes. This is the requirement families most often miss. The Guardianship Assistance Agreement must be fully negotiated, approved, and executed before the dependency court enters the final Permanent Guardianship order under Fla. Stat. § 39.6221. If the judge closes the case first, Title IV-E GAP eligibility is forfeited — permanently. There is no retroactive fix.

Extended GAP to Age 21

Standard GAP payments end at 18. But Florida law extends coverage — monthly payments plus Medicaid — to age 21 if the original GAA was signed when the youth was 14, 15, 16, or 17 years old.

To maintain Extended GAP, the young adult must stay engaged in at least one qualifying activity:

  • Finishing high school or a GED program
  • Enrolled in postsecondary or vocational education
  • Working at least 80 hours per month
  • Participating in a program that removes barriers to employment
  • Documented inability to participate due to a verified medical condition

How the Timeline Works in Practice

Most families reach GAP after a progression: informal care → dependency placement → RCP → Level 1 licensure → GAP. The critical six-month licensed window typically begins once the CBC case manager helps complete the Level 1 license application. Florida Statute § 409.175 allows waivers of non-safety licensing standards for relatives, so the process is less burdensome than standard foster licensing.

Once the six months are satisfied and reunification is ruled out, the case plan shifts toward permanent guardianship. This is when the GAA negotiation happens — and the moment to push for a higher monthly rate if the child's needs justify it. Do not sign until you are satisfied with the terms. Do not let the court close the case until the GAA is fully executed.

What GAP Does Not Cover

GAP is a financial and healthcare subsidy. It does not provide:

  • Legal advice or court representation (use free legal aid through FloridaLawHelp.org or the Senior Legal Helpline at 1-888-895-7873)
  • School enrollment authority (a separate permanent guardianship order handles this)
  • Legal, court, or administrative costs above the $2,000 reimbursement cap
