Arizona Guardianship Assistance Program (GAP): Subsidy for Kinship Caregivers

What GAP Is and Who It's For

Arizona's Guardianship Assistance Program provides monthly subsidies to relative caregivers who assume permanent legal guardianship of a child exiting the state child welfare system. It's established under ARS § 8-814 and administered by the Department of Child Safety.

GAP exists for one specific situation: a child was in DCS custody, lived with a relative in a kinship placement, and now the relative is becoming the child's permanent guardian instead of the child returning to the parent or being adopted. The subsidy helps make that permanent arrangement financially sustainable.

The Five-Step Eligibility Pipeline

GAP has strict sequential requirements. Missing any step disqualifies the subsidy.

1. Dependency adjudication. The child must have been formally adjudicated dependent by the juvenile court and placed in DCS legal custody.

2. Six consecutive months in your home. The child must have lived in your home — licensed or unlicensed — for at least six consecutive months immediately before the guardianship is established.

3. Reunification and adoption ruled out. DCS and the juvenile court must have formally determined that returning the child to the parent and adoption are not viable permanency options.

4. GAP agreement signed before the guardianship order. You and DCS must execute a formal GAP agreement before the court enters the permanent guardianship order. This timing is non-negotiable. Signing the agreement after the court order is entered makes the subsidy unavailable.

5. Court finalizes the permanent guardianship. The juvenile court enters the permanent guardianship order, and monthly payments begin.

Payment Amounts

GAP subsidies are negotiated between the caregiver and DCS based on the child's specific needs. Payments are structured up to state-established ceilings tied to standard foster care maintenance rates. A child with higher special needs may receive a larger monthly subsidy.

The exact amount varies by case. DCS evaluates the child's special needs when setting the subsidy level. Ask the DCS specialist to confirm the expected payment term and any extension rules in the GAP agreement.

AHCCCS Coverage Continues

Children enrolled in GAP automatically maintain eligibility for AHCCCS Medicaid. Ask the DCS specialist what enrollment or renewal steps apply to your case.

Probate Guardianship Does Not Qualify

This is the most common point of confusion. If you obtained legal guardianship through probate court (Title 14, ARS § 14-5204 or § 14-5207) without the child ever being in DCS custody and formal dependency proceedings, you cannot access GAP.

Probate guardianships are a different legal track. They give you custody and authority over the child, but they don't carry the DCS subsidy because the child was never in the child welfare system. Relatives with probate guardianships access financial help through child-only TANF, SNAP, AHCCCS and DES child care assistance — not GAP.

Why the Timing of the Agreement Matters

Step 4 trips up families more than any other. If the court enters the permanent guardianship order before you and DCS sign the GAP agreement, the subsidy window closes. There is no retroactive access.

If you're in a DCS kinship placement and the case is moving toward permanent guardianship, raise the GAP agreement with your DCS specialist early. The agreement needs to be fully executed and on file before the guardianship hearing.

The Arizona kinship financial help guide maps out each arrangement type — informal, probate guardianship, DCS placement, GAP — and the specific financial benefits available under each one.
