How to Enroll a Grandchild in School Without Custody in Washington
The child is living with you, school starts Monday, and you have no custody order. In Washington, you do not need one. Every child has a constitutional right to attend public school in the district where they live, and OSPI policy is explicit: districts cannot require a court custody order as a condition of enrolment.
What You Actually Need to Bring
Washington districts are required to enrol students based on three things:
- Proof of residency. Documentation showing the child lives within the district boundaries with you — a utility bill, lease, or a signed caregiver affidavit confirming the living arrangement.
- Proof of age and identity. Birth certificate, passport, or a certified statement from a physician or government agency.
- Immunisation records. A completed Certificate of Immunisation Status (CIS) form showing up-to-date vaccinations, or a valid medical or religious exemption.
That is the mandatory list. Prior transcripts, discipline records, and learning plans are useful but not required for enrolment — the new district requests them directly from the old school.
The Caregiver Authorisation Form
Most districts have their own caregiver authorisation or affidavit form. Seattle Public Schools, for example, uses a standardised "Authority and Responsibility for a Minor Student" form alongside a digital host-family/caregiver form through its Enrollment Services portal. Rural districts may use a simpler paper affidavit handled at the building level.
Ask the registrar for the district's caregiver authorisation form. If the district does not have one, ask what documentation it accepts. A signed caregiver affidavit is one way to document the child's residence.
What the School Cannot Demand
A district cannot require any of the following as a condition of enrolment:
- A court custody order or legal guardianship decree
- A parent's co-signature (though some districts request it — it is not mandatory)
- A social worker's letter or DCYF involvement
- Proof that you are the child's legal guardian
If a registrar insists on a custody order, they are applying a standard that OSPI does not impose. You have three escalation paths:
- The district's homeless/foster care liaison. Every Washington district has one. They are trained on the enrolment rights of children in non-traditional living situations.
- OSPI Dispute Resolution. File a formal enrolment dispute with OSPI's Equity and Civil Rights Office or Foster Care Education Programme.
- The Governor's Office of the Education Ombuds (OEO). OEO mediates directly with school district administration and can move a stalled enrolment quickly.

Immunisation Gaps and Provisional Enrolment
If the child's immunisation records are missing, provisional enrolment may last up to 30 calendar days if the child has received at least the first dose of each required vaccine series. You can access the child's immunisation history through the state's MyIR Mobile system or through the local public health clinic.
If you have signed a health declaration under RCW 7.70.065, you have the authority to consent to the catch-up vaccinations yourself.
Keeping the Enrolment Current
Unlike the health declaration (which expires every six months), school enrolment typically holds for the academic year. But some districts require annual renewal of the caregiver authorisation form each fall. Ask the registrar about the renewal cycle when you first enrol the child — getting caught flat at the start of a new school year is avoidable.
Our Washington School and Medical Consent Guide covers the enrolment process alongside medical consent, including district-specific tips and the exact escalation steps for when a school says no.
