Emergency and Interim Kinship Care Orders in Scotland

When You Can't Wait for the Full Process

The full Section 11 process includes service and a 21-day Notice of Intention to Defend period; contested cases may go on to hearings and proof. But some situations can't wait. A birth parent threatens to remove the child from your home. A parent's sudden incapacity leaves no one else to care for the child. Or the child is at immediate risk and needs legal protection now.

In these situations, Scots law allows for interim orders that provide temporary legal authority while the full case proceeds through the sheriff court.

How Interim Orders Work

When filing the Initial Writ for a Section 11 order, your solicitor can include a crave (request) for an Interim Residence Order or Interim Interdict alongside the main application. The sheriff can hear this motion before the main case is resolved and grant temporary arrangements before the birth parents have responded.

An Interim Residence Order gives you temporary legal authority to have the child live with you. An Interim Interdict can prevent specific actions — for example, prohibiting a birth parent from removing the child from your address or from Scotland.

These interim orders last until the sheriff replaces them with further interim orders, the case settles, or the final order is granted.

Ex Parte Motions (Without Notice)

In cases of extreme urgency, a solicitor can bring an interim motion ex parte — heard by the sheriff without advance notice to the other side. This is reserved for situations where giving notice would defeat the purpose, such as a real and immediate risk that a parent will remove the child before the hearing.

An ex parte order is always temporary. The court will immediately order emergency service on the birth parents and schedule an expedited Child Welfare Hearing — typically within a few days — so the parents can challenge the interim order. The sheriff balances urgency against fairness: ex parte orders are granted sparingly and only when the child's safety requires it.

What About the Children's Hearing System?

If the child is already subject to a Compulsory Supervision Order (CSO), the Children's Hearings System remains involved in the child's case. A private Section 11 application in the sheriff court runs alongside that process; once the Kinship Care Order is granted, the child leaves the Children's Hearings System and their looked-after status ends.

If the child is not in the hearing system, a private applicant can seek a Section 11 order in the sheriff court. If there's immediate danger, contact Police Scotland or the local authority's emergency social work duty team as well.

What Is a Safeguarder?

The Children's Hearings System and the sheriff court have different processes. A Safeguarder may be involved in the Children's Hearings System; the sheriff court may appoint a Child Welfare Reporter to investigate and report on the child's circumstances.

In exceptional circumstances, the sheriff court may appoint a curator ad litem if the child needs independent legal representation to safeguard their legal position. This is a separate role from the Child Welfare Reporter.

Speed Matters — So Does Legal Representation

Emergency motions require precise legal drafting and an understanding of when the court will and won't act without notice. This is not a process for self-representation. If you're in a crisis situation, contact a family law solicitor immediately. If cost is a barrier, ask the solicitor whether you qualify for SLAB Advice and Assistance, which can cover initial advice and drafting.
