Emergency Guardianship in Georgia: When You Need an Urgent Court Order

When a child is in immediate danger, act through emergency child-protection services rather than waiting for a probate filing. Georgia Probate Court Standard Form 11 and O.C.G.A. § 29-4-10 concern emergency guardianship of a proposed ward under the adult-guardianship chapter; they are not the emergency minor-guardianship route.

What Qualifies as an Emergency

GPCSF 11 is a petition for appointment of an emergency guardian and/or conservator for a proposed ward under Title 29, Chapter 4. For a minor, the standard probate petition is GPCSF 28 under O.C.G.A. § 29-2-5. Do not use GPCSF 11 or § 29-4-10 to seek guardianship authority over a child.

If a child faces immediate danger, contact law enforcement or the Georgia DFCS Child Abuse Intake Reporting Line at 1-855-422-4453. If you need a probate guardianship for a minor and there is no active child-welfare case, use the standard GPCSF 28 process and its notice rules.

How Minor Guardianship Petitions Work

The minor-guardianship process uses GPCSF 28, not GPCSF 11. A parent who has not consented must receive statutory notice. The response period is 10 calendar days from personal service, 14 calendar days from the date of mailing to an out-of-state parent, or 10 calendar days from the second publication when the parent's location is unknown.

Notice and Objections

A timely objection by a natural guardian means the probate court must dismiss the temporary-guardianship petition or transfer the matter to Juvenile Court. GPCSF 28 is not an emergency order or a shortcut around the required notice process.

Emergency Custody Orders Through Other Courts

If DFCS is already involved or a dependency proceeding is open, the juvenile court — not probate court — handles the case under Title 15, Chapter 11. That is a separate process from a probate temporary-guardianship petition.

If a Superior Court divorce or custody decree already exists, emergency modifications go through Superior Court.

What You Should Have Ready

If you can do so without delaying emergency help, keep your ID, proof of your relationship to the child, relevant police or medical records, and the child's birth certificate available. These records can help the appropriate agency or court understand the situation.

Our Georgia Guardianship and Custody Court Process Guide covers urgent child-safety questions alongside the standard process, so you can identify the right next steps.
