Wyoming McKinney-Vento Grandparent Enrollment
What McKinney-Vento Covers
The McKinney-Vento Homeless Assistance Act (42 U.S.C. § 11431 et seq.) is a federal law that protects school enrollment for children who lack a fixed, regular, and adequate nighttime residence. That definition includes children who are "doubled up" — sharing housing because of loss of housing, economic hardship, or a similar reason.
An eviction or financial hardship may lead to a child qualifying for McKinney-Vento protections even though your home is stable. A parent's treatment, incarceration, or absence by itself does not establish eligibility; the liaison assesses the child's housing situation.
What the Protections Actually Do
McKinney-Vento eligible students must be enrolled immediately, even when the caregiver cannot produce:
- A certified birth certificate
- Immunization records
- Prior academic transcripts
- Legal guardianship papers or a court order
The enrolling school district is legally required to help gather missing records after enrollment — not before. The child also has the right to stay enrolled in their "school of origin" (the school they attended when permanently housed or the school in which they were last enrolled) and to receive district-provided transportation to that school if the parent or guardian requests it.
These protections override the front-desk demand for guardianship papers that blocks many kinship caregivers.
How to Trigger the Protections
Every Wyoming school district is required to have a trained McKinney-Vento homeless education liaison. The problem is that front-desk enrollment staff rarely connect caregivers to this person automatically. You usually have to ask.
When you arrive at the school to enroll a child:
- Ask to speak with the district's McKinney-Vento liaison by name or title. If the enrollment clerk doesn't know who that is, ask for the principal or district superintendent's office.
- Explain the child's housing situation — that the child is living with you because the parent lost housing, is in crisis, or is unable to provide a home. You don't need to share every detail.
- Request immediate enrollment while records are gathered. Cite McKinney-Vento by name. The liaison is trained to process this.
The word "homelessness" is the barrier for many grandparents. Your home isn't unstable — but the child's prior living situation was. McKinney-Vento covers the child's circumstances, not yours.

Free School Meals and Other Benefits
Children who qualify under McKinney-Vento are categorically eligible for free breakfast and lunch under the National School Lunch Program and School Breakfast Program. No household income documentation is needed. Once the school receives direct-certification documentation, it must make free meals available as soon as possible and no later than three operating days. Ask the liaison to coordinate with the school nutrition office.
If McKinney-Vento doesn't apply but the child is included in a household receiving SNAP benefits or POWER (Wyoming's TANF program), the child can qualify for free school meals through direct certification.
When McKinney-Vento Doesn't Apply
McKinney-Vento covers housing instability, not every kinship arrangement. If a parent voluntarily placed the child with you while the parent maintains stable housing elsewhere, the child likely doesn't meet the "doubled-up" definition. In that case, you'll need either a notarized parental consent letter or a temporary guardianship order under W.S. §§ 3-2-301 through 3-2-303 to enroll the child.
