Texas Guardianship and Custody Financial Help for Grandparents Raising a Grandchild
You went to court, hired a lawyer, and got legal custody or guardianship of your grandchild. Now you are looking for the financial help that should come with that responsibility — and discovering that Texas does not have a straightforward "guardianship subsidy" for private custody arrangements.
This is the biggest gap in the Texas kinship system, and it surprises nearly every grandparent who goes through it.
The Hard Truth About Private Guardianship in Texas
Texas has no statewide financial subsidy program for grandparents or relatives who obtained guardianship or managing conservatorship through a private family court case — meaning a case that did not involve DFPS and the child welfare system.
The DFPS programs that pay monthly stipends — the $23.45/day Kinship Reimbursement (RODC) and the $400–$545/month Permanency Care Assistance (PCA) — require the child to have been in DFPS conservatorship. A private guardianship under Estates Code Chapter 1104 or a managing conservatorship under Family Code Chapter 153, filed without a prior DFPS removal, does not create eligibility for these payments.
This distinction frustrates caregivers who assumed that having legal custody would unlock more help, not less. PCA is a Title IV-E program, while RODC eligibility is tied to a child being in DFPS conservatorship; both are child-welfare pathways rather than private-custody subsidies.
What You Can Access With a Private Custody Order
Having legal custody or guardianship does give you full authority to apply for every HHSC-administered benefit on the child's behalf:
Child-Only TANF. With a court order naming you as managing conservator or guardian, your eligibility is clear-cut. The child qualifies based on their own income (not yours), and you apply as the non-needy caretaker payee. The maximum grant is $132/month for one child.
One-Time TANF for Relatives (OT-TANF). The $1,000 grant is for grandparents, aunts, uncles, or siblings age 25 or older. The child must already be certified for ongoing TANF, gross income must be at or below 200% of the federal poverty level, and countable resources must not exceed $1,000. It is limited to once in a lifetime per relative/child group. A guardianship order is not required.
SNAP. Household food benefits evaluated under standard SNAP income rules. If you are age 60 or older, the gross income test is waived and you qualify based on net income alone, with deductions for medical expenses and shelter costs.
Children's Medicaid and CHIP. The child is evaluated as a separate MAGI household if you do not claim them as a tax dependent. Your income is excluded from the child's eligibility determination.
TWC childcare subsidies. If you are working or in training, you can apply for subsidized childcare through your local Workforce Solutions board.
When DFPS Subsidies Do Apply
If DFPS was involved in the child's removal and placed the child with you before the court granted managing conservatorship, the pathway is different:
- You may already be receiving the $23.45/day kinship reimbursement
- If you complete foster home verification and sign a PCA agreement before the final PMC order is entered, you qualify for PCA ($400–$545/month ongoing)
- If you received PMC without completing verification, you qualify for the $500/year post-PMC reimbursement for up to three years
The timing of the PCA agreement relative to the court order is everything. If the court enters PMC before the PCA agreement is signed, PCA is permanently unavailable for that placement.

Making the Most of What Is Available
The combined value of HHSC benefits for a grandparent with private custody can still be significant. Child-Only TANF ($132/month) plus SNAP (up to $536/month for a two-person household) plus free Medicaid for the child plus the $1,000 OT-TANF grant adds up — especially for a retired grandparent on a fixed income who assumed none of these applied to them. A Child-Only TANF grant counts as unearned income in SNAP calculations and can reduce the SNAP allotment.
The Texas Kinship Financial Help guide maps every program available to private guardianship and custody holders alongside the DFPS-connected programs, with a benefit eligibility decision tree that starts from your legal arrangement and shows exactly which pathways are open. It includes the TANF grant worksheet and the document audit checklist so your applications are complete on the first submission.
