Tennessee Standby Guardianship: Planning Ahead When a Parent Faces Illness or Incapacity

What Standby Guardianship Does

Standby guardianship lets a parent plan ahead. Under T.C.A. § 34-1-119(c)(1), a custodial parent or a person the parent has designated may petition for a guardian before fiduciary services are currently needed. If the court appoints a standby guardian, its order defines the circumstances that activate the guardian and the steps for notifying the court. A trigger may be the parent's incapacity or death, or another condition the court includes in its order.

This is different from a standard guardianship petition, where the appointment becomes effective after the court enters an order, the fiduciary takes an oath, and any required bond is posted. Letters of guardianship are the effective evidence of appointment. It is also different from a power of attorney for care of a minor child, which is a non-judicial document that any parent with legal custody can revoke at will.

Who Uses It

Standby guardianship is designed for parents who are still capable of caring for their child today but know that may change:

  • A parent diagnosed with a terminal illness who wants to ensure a smooth transition
  • A parent facing a medical procedure with a significant risk of incapacity
  • A parent whose health is deteriorating progressively

The parent chooses the nominee — typically a grandparent, sibling, or other trusted relative — and the court evaluates whether that person is suitable.

How the Process Works

The parent files a petition in court requesting the appointment of a standby guardian. The petition identifies the nominee, describes the triggering condition, and explains why the arrangement is needed. The court reviews the petition, may order background checks on the proposed guardian and adult household members, and enters an order designating the standby guardian.

The court's order defines the trigger and the actions needed to notify the court. The standby guardian does not automatically assume authority when the trigger occurs. The court must find there is a need for an active fiduciary and issue an order authorizing the standby guardian to function.

What It Does Not Do

Standby guardianship does not terminate the parent's rights. While the parent remains capable, the parent keeps full legal authority. The standby guardian has no decision-making power until the triggering event.

It also does not bypass the other parent. If both parents are alive and have legal rights, the other parent's rights must be addressed — through consent, proper notice, or the substantial-harm standard if the other parent objects.

Standby Guardianship vs. Other Options

Feature Standby Guardianship Power of Attorney (T.C.A. § 34-6-301) Standard Guardianship
When authority begins After the court issues an activation order Immediately upon execution After the court order, oath, and any required bond
Court involvement Yes — court designates the guardian No — non-judicial document Yes — court appoints the guardian
Parent can revoke By court petition while competent By written instrument at any time By court petition showing changed circumstances
Scope The activation order sets the powers and any limits School enrollment and routine healthcare The court order sets the powers and any limits

Planning Ahead Protects the Child

A parent who waits until a crisis hits leaves relatives scrambling for emergency orders under tight deadlines. A standby guardianship puts the plan in place while the parent is healthy enough to choose the right person and participate in the court process.
