Social Security Appeal for a Grandchild Denied Benefits: Deadlines and Steps

The 60-Day Clock Starts When You Receive the Notice

When the SSA denies a grandchild's benefit claim, you'll receive a written notice explaining the decision. You have 60 days from the date you receive that notice to file an appeal. SSA presumes you received it 5 days after the date on the notice, so the usual deadline is 65 days from the notice date.

If you miss that window, the denial may become final. Filing a new application can affect the date used to calculate any back payments, so act promptly if you plan to appeal.

Mark the deadline on a calendar the day the notice arrives. Don't wait to "figure out what went wrong" before filing — you can file the appeal and provide supporting evidence afterward.

Level 1: Reconsideration (Form SSA-561)

The first step is filing Form SSA-561 (Request for Reconsideration) for non-medical issues, or Forms SSA-3441 and SSA-827 if the denial involves a medical disability determination.

Reconsideration is a complete independent review by a different SSA team — not the same people who made the initial decision. You can submit new evidence, correct errors in the original application, and explain why the denial was wrong.

Common reasons grandchild claims get denied and what to address in reconsideration:

  • "Not a grandchild" (Disallowance Code 25): The SSA determined the child doesn't meet the statutory definition for grandchild benefits on the grandparent's record. If both parents truly are deceased or disabled, provide updated death certificates or medical evidence. If a parent's disability status was unclear, request that the SSA initiate a parent disability determination.

  • Dependency test not met: The SSA found insufficient proof that you provided at least 50% of the child's financial support. Submit additional household expense documentation — utility bills, rent receipts, bank statements, school fee payments — covering the full 12-month period immediately preceding the reference month, or substantially all of the period from birth if the child was born during that year.

  • Parent not insured: The earner didn't accumulate enough work credits. Check whether the other parent's record might be viable, or consider an SSI claim instead.

Level 2: Administrative Law Judge Hearing

If reconsideration is denied, you can request a hearing before an Administrative Law Judge by filing Form HA-501 within 60 days. This is a de novo hearing — the ALJ reviews everything fresh, and you can present witness testimony, medical experts, and vocational evidence.

ALJ hearings are where many initially denied claims succeed, particularly complex grandchild cases involving contested parent disability status. The hearing is more thorough than the paper review at reconsideration.

Levels 3 and 4: Appeals Council and Federal Court

If the ALJ denies the claim, Form HA-520 requests Appeals Council review (also within 60 days). The Appeals Council evaluates whether the ALJ made legal errors or abused discretion. Beyond that, the final option is filing a civil complaint in federal district court within 60 days of the Appeals Council's decision.

Most kinship benefit claims resolve at reconsideration or the ALJ level. Federal court is rare and typically involves novel legal questions.

Continued Benefits During a Medical Appeal

If the SSA determines a disabled child is no longer medically eligible and you file for reconsideration within 10 days of receiving the cessation notice (not 60), you can elect to continue receiving benefits while the appeal is pending. This shorter deadline catches many caregivers off guard — don't confuse it with the standard 60-day window.

Don't Navigate This Alone

Free legal help is available for low-income caregivers through Legal Services Corporation (LSC) legal aid offices and state kinship navigator programs. Many offer specific assistance with Social Security appeals.
