New Hampshire School Enrollment Documents for Kinship Caregivers

The Document Stack a Kinship Caregiver Needs for School

Walking into a school administrative unit (SAU) office without the right documents means walking out without an enrollment. For grandparents and relatives raising a child without a court order, knowing exactly what's required — and what the district can and can't demand — prevents the worst outcome: a child sitting at home while paperwork gets sorted.

Here's a practical document checklist for New Hampshire school enrollment as a kinship caregiver. District document procedures vary, so confirm the list with your SAU.

Proof of Residency in the District

Under RSA 193:12, a child's legal residence for school attendance is the municipality where the parents reside. When a child lives with a relative, the school district needs evidence that the caregiver actually lives within district boundaries.

Acceptable proof typically includes:

  • A current utility bill (electric, gas, water) in the caregiver's name
  • A signed lease or rental agreement
  • A property tax bill or deed
  • A bank statement or official mail showing the caregiver's address

Most SAUs accept two forms of residency proof. If a guardianship or legal-custody petition is filed on behalf of a relative, RSA 193:12 permits the child to attend in the district where the relative lives while the court decides the case; a final guardianship order is not required first.

Identity and Age Verification

Bring the child's official birth certificate (or a certified copy) to document age. A Social Security number is voluntary and cannot be a condition of enrollment; if you have the card, it may help match school records. If the birth certificate is missing, a district may request another age document, but it may not prevent or discourage enrollment because you lack a birth certificate.

Immunization Records

For school enrollment, RSA 141-C:20-a requires evidence of immunization, age-appropriate partial immunization as allowed by rule, or an exemption under RSA 141-C:20-c.

If the child's records are with a previous pediatrician or school, the new school can request a transfer. If records are unavailable, the school nurse can help identify what's needed and connect you with a provider.

Under RSA 141-C:20-c, a parent or legal guardian may sign a form for a religious exemption. An informal caregiver cannot sign that form as the parent or legal guardian. If you are appointed guardian, ask the school how to update the child's immunization record; the statute does not say that a prior parent's exemption can be overridden only by a court order.

Court Orders or Delegation Documents

This is where kinship caregivers face the most friction. Bring whatever legal documentation you have:

  • Proof of a filed RSA 463 guardianship or legal-custody petition — RSA 193:12 permits the child to attend in the relative's district while the petition is pending
  • A temporary agent appointment under RSA 461-A:19-a — signed by the parent or guardian, witnessed by two adults age 18 or older (neither is the agent), and accepted in writing by the agent. If there is no parenting plan, a known other living parent who is willing and able to safely provide care generally must consent in writing, unless a statutory exception applies. Other appointment limits in RSA 461-A:19-a, III also apply.
  • A notarized parental delegation letter — accepted at the district's discretion but better than nothing

If the child qualifies under McKinney-Vento (lacking a fixed, regular, and adequate nighttime residence due to housing loss or family crisis), the district must enroll immediately without any of these documents. Contact the district's McKinney-Vento homeless liaison to invoke these protections.

Previous School Records

Academic transcripts, report cards, and IEP or Section 504 documentation from the child's previous school help with grade placement and continuing any special education services. If you can't get these before enrollment, the new school can request them directly from the prior district.

What the District Cannot Require

A school district cannot demand a final guardianship order as a condition of enrollment when you've filed a pending petition under RSA 193:12. They also cannot refuse enrollment of a McKinney-Vento eligible child for missing documents — the law requires immediate enrollment followed by records collection.

If a residency dispute has interrupted educational or related services, or is likely to do so if a decision cannot be made within 30 days, a parent or legal representative may submit the dispute to the Commissioner of the New Hampshire Department of Education under RSA 193:12, VI(a). In those circumstances, the commissioner must decide within 14 days.
