Michigan Guardianship Lawyer Cost
What Attorneys Typically Charge
Attorney fees for minor guardianship cases in Michigan vary widely based on whether the case is contested and how much work is involved.
Uncontested guardianship — When the custodial parent or parents consent or no one opposes: ask whether the attorney offers a flat fee or hourly representation, and request a written estimate of what it covers.
Contested guardianship — When a parent objects and the case requires testimony, evidence presentation, or a Guardian ad Litem investigation, ask the attorney for a written estimate that accounts for the expected hearings and other work.
Attorney fees are separate from court costs. The probate filing fee is $175, and certified Letters of Guardianship cost $12 per copy. Ask the court or service provider about any other local costs.
What Drives the Cost Up
Several factors push guardianship attorney fees higher:
- Contested vs. uncontested — This is the biggest variable. A parent's objection can add substantial legal work and delay resolution.
- Multiple hearings — If the court continues (postpones) hearings, orders additional investigations, or schedules separate temporary and permanent hearings, each appearance adds billable hours.
- Complex notice requirements — Serving an incarcerated parent under MCR 2.004, locating a missing parent for service by publication, or handling out-of-state service all require extra legal work.
- ICWA involvement — Cases involving the Indian Child Welfare Act require specialized forms, heightened procedural requirements, and sometimes tribal court coordination.
- Guardian ad litem costs — Ask the court whether any fee applies to an appointment and who would be responsible for it.
Alternatives to Full Representation
If the full cost of an attorney is out of reach, several options reduce or eliminate the expense:
Filing pro se (without a lawyer). Michigan's SCAO forms are free and designed for self-represented filers. Many grandparents and relatives successfully petition for uncontested guardianship without an attorney. The probate court can't give legal advice, but clerks can answer procedural questions about filing and scheduling.
Limited-scope representation. Ask whether an attorney offers "unbundled" services — such as reviewing completed forms or attending a hearing — without taking on the full case, and what those services cost.
Legal Aid programs. Legal Aid of Western Michigan, Legal Services of South Central Michigan, Lakeshore Legal Aid, and Michigan Advocacy Program provide legal-aid or advocacy resources in the areas they serve. Eligibility and capacity vary, so contact the local provider.
Michigan Legal Help (michiganlegalhelp.org) offers free articles, automated form-preparation tools, and referral directories that connect you with local legal aid offices.
Law school clinics. University of Michigan, Wayne State, Michigan State, and other law schools operate family law clinics that handle guardianship cases pro bono during the academic year.

Breaking Down the Total Cost
For a relative filing an uncontested guardianship without an attorney:
| Expense | Cost |
|---|---|
| Probate court filing fee | $175 |
| MC 20 fee waiver, if approved | $0 for filing fee |
| Certified Letters of Guardianship | $12 per copy |
| Local background checks or service costs | Confirm with the court or provider |
An approved MC 20 waiver removes the filing fee; other costs may still apply.
