Michigan Guardianship Background Check

Two Checks, Both Mandatory

Michigan courts conduct background vetting before appointing a minor guardian. This includes a child abuse/neglect Central Registry clearance and a county-specific criminal-history authorization. Proposed guardians and adult household members are included in the checks.

1. Central Registry Clearance (DHS-1929) — This requests a child abuse/neglect history check through the Michigan Department of Health and Human Services (MDHHS) Central Registry.

2. Criminal History Check — A county-specific criminal background authorization. The local form and submission process can vary by county; ask the probate court where to submit it.

How the Central Registry Check Works

Form DHS-1929 (Central Registry Clearance Request) is part of the guardianship paperwork. Submit the clearance requests for the proposed guardian and adult household members as directed by the court.

MDHHS uses the form for the Central Registry clearance. Submit it when the court directs and ask the probate court about expected processing time and any fee.

What Triggers a Problem

The court reviews background clearances and investigation results when deciding whether the proposed placement is safe and appropriate. If a result concerns you, gather relevant records and discuss the case with a Michigan attorney before the hearing.

The Criminal History Check Process

The criminal-history authorization is local. Ask the probate court clerk which county form to use, where to submit it, and whether a fee applies.

Timeline Impact

The court reviews background clearances as part of its appointment decision. Filing, investigation, and hearing schedules vary by county, so confirm when to submit each authorization. The court may also order a home assessment or appoint a Guardian ad Litem when needed.

If immediate authority is needed while the full or limited guardianship petition is pending, ask the court about a temporary appointment under MCL 700.5213, which is capped at six months.

The Michigan Guardianship and Custody Court Process Guide includes a filing-order checklist that shows when to submit each background check form and how to track clearance timelines so nothing holds up your hearing date.
