Medical Consent for Grandparents Caring for a Child in Tasmania

What You Can Consent To Without a Court Order

If you're an informal kinship carer in Tasmania — raising a grandchild or relative's child without DECYP involvement or a court order — your medical authority has limits. But those limits are narrower than most carers fear.

Routine medical care — GP consultations, childhood immunisations, standard prescriptions, routine dental — is generally fine. Health care providers in Tasmania operate under duty-of-care frameworks. If a child lives with you full-time and you present them for a routine appointment, most GPs and dentists will proceed. Having the child listed on your Medicare card and carrying a statutory declaration of care usually removes any hesitation.

Significant or invasive procedures — surgery, general anaesthesia, major dental work — require consent from the legal guardian. For informal arrangements, the biological parents retain that authority. In practice, this means you need to contact the parent for consent or have a court order that grants you decision-making power.

Emergency treatment is the exception. Medical practitioners have common-law authority to perform life-saving interventions without anyone's consent when delay would endanger the child's life or health. You don't need paperwork for a genuine emergency.

Getting a Child on Your Medicare Card

A child needs to be listed on a valid Medicare card to access bulk-billed services and subsidised medicines. If the child was on the parent's card, you can transfer or re-enrol them onto yours.

Use the Medicare Enrolment Form (MS004) from Services Australia. You'll need:

  • The child's birth certificate, passport, or ImmiCard
  • Proof of your identity
  • Evidence of primary care — a Centrelink principal carer determination, a court order, or a statutory declaration with supporting professional letters

If you don't have the child's birth certificate, contact Services Australia to discuss alternative identity evidence. The Grandparent Adviser Line on 1800 245 965 can help navigate missing documentation.

Immunisation Records

The Australian Immunisation Register (AIR) holds the child's immunisation history. You can access it through your myGov account once the child is linked to your Medicare card. Schools require an up-to-date immunisation history statement for enrolment, so sorting Medicare access early feeds into school paperwork too.

If the child's vaccinations are behind schedule, your GP can create a catch-up plan. National Immunisation Program vaccines are free to people eligible for Medicare, but the provider may charge a consultation fee. Check the cost when booking.

The Foster Child Health Care Card

If you've established principal carer status with Centrelink, apply for a Foster Child Health Care Card. It's issued in the child's name regardless of your income and unlocks:

  • GP visits that the doctor chooses to bulk bill
  • Cheaper Pharmaceutical Benefits Scheme (PBS) medicines
  • Access to the Child Dental Benefits Schedule (CDBS) — capped coverage for basic dental over two calendar years

This card sits alongside any concession card you hold personally (Pensioner Concession Card, Health Care Card). Both contribute to keeping medical costs down.

Mature Minor Consent

Under Australian common law, a young person under 16 who demonstrates sufficient maturity and understanding — known as Gillick competence — can consent to their own medical treatment independently. This becomes relevant for older children in kinship care, particularly around reproductive health, mental health services, and counselling. The treating practitioner makes the assessment on a case-by-case basis.

Keeping Medical Records Organised

The Support for Grandparents and Kinship Carers in Tasmania guide includes a medical consent reference card and a health records checklist that covers Medicare transfer, immunisation catch-up, dental schedule, and what to carry to every medical appointment. It's built for carers who took on a child suddenly and need to assemble the health paperwork from scratch.
