Kentucky Power of Attorney for a Minor Child: What Grandparents Need to Know

If you're a grandparent in Kentucky about to take on care of a grandchild, you've probably searched for a "temporary guardianship form." What Kentucky actually offers is a Power of Attorney for Temporary Delegation of Parental Rights, created in 2016 under KRS 403.352 and KRS 403.353. It works differently from what most people expect — and it requires the parent's active cooperation.

How the Kentucky Minor Child POA Works

A parent or legal guardian executes the power of attorney, naming you (or any other adult) as the "attorney-in-fact." The parent signs the document, you sign an acceptance, and both signatures are acknowledged before a notary. Once executed, it delegates the parent's parental rights and responsibilities regarding the child's care and custody, subject to the statutory exclusions.

The statutory form is codified at KRS 403.353. Generic power of attorney templates from online form sellers don't carry the same statutory protections, and schools or doctors may reject them.

The Critical Difference: The Parent Must Sign

This is where the POA parts ways from the caregiver affidavit. A power of attorney absolutely requires the parent's signature, notarized. There is no provision for executing it when the parent is unavailable, incarcerated, or can't be found.

If a required parent or legal custodian is unavailable to sign, an adult caregiver who lives with the child may use the Caregiver Authorization Affidavit under KRS 405.024 after documenting the circumstances and reasonable efforts to locate them. The affidavit does not override a reachable parent's contrary decision.

Who Can Be Named as Attorney-in-Fact

The power of attorney can name any adult — family friends, godparents, neighbors, or anyone the parent trusts. Before execution, Kentucky requires a criminal history and child abuse/neglect background check for anyone other than a grandparent, aunt, uncle, or adult sibling.

Duration and Renewal

The power of attorney lasts a maximum of one year. For active military parents, it extends for the length of deployment plus 30 days. Unlike the caregiver affidavit, the POA statute has no express renewal clause — you'd need to execute an entirely new document after the year is up.

What the POA Cannot Cover

Kentucky's minor child POA has its own list of exclusions. The attorney-in-fact cannot consent to:

  • Marriage of the minor
  • Abortion or induced termination of pregnancy
  • Adoption of the child
  • Termination of parental rights

The POA also cannot be used solely to establish school residency in a different district — it must reflect a genuine caregiving arrangement.

POA vs. Caregiver Affidavit: Which Do You Need?

Caregiver Affidavit (KRS 405.024) Power of Attorney (KRS 403.352)
Who starts it Adult caregiver who lives with the child The parent
Parent signature Required unless parent or other required signer is unavailable Mandatory
Non-relatives eligible The statutory definition covers an adult who lives with the child Yes (with background check, subject to statutory exceptions)
Third-party immunity Yes — explicit statutory protection No express statutory protection
Duration 1 year, renewable 1 year, no renewal clause
Notarization Required Required

Most grandparents and relatives raising a child informally use the caregiver affidavit because it doesn't depend on getting the parent to a notary when the parent is unavailable. The POA is another option when the parent is cooperative and wants to delegate parental rights and responsibilities.
