Kansas McKinney-Vento Act: School Enrollment for Children Living with Grandparents
A grandchild shows up at your door because the parents lost their housing, or you are sharing your two-bedroom apartment with your daughter's children after an eviction. The child needs to start school on Monday, and you have no custody paperwork, no birth certificate, and no immunization records handy. The McKinney-Vento Act may be the fastest path to enrollment Kansas recognizes.
What McKinney-Vento Covers
The McKinney-Vento Homeless Assistance Act (42 U.S.C. § 11431) is a federal law that requires every public school district in Kansas to immediately enroll children experiencing housing instability. "Immediately" means the district must not wait for missing records or a power of attorney.
A child qualifies for McKinney-Vento protections when they are "doubled-up," meaning the family is sharing housing with others due to loss of housing, economic hardship, eviction, natural disaster, or a similar crisis. A grandchild living with you because the parents cannot maintain stable housing fits this definition.
What McKinney-Vento Does Not Cover
This is important: a child living with grandparents purely as a matter of voluntary family preference — where the parents have stable housing elsewhere and no hardship exists — does not meet McKinney-Vento criteria. The law is designed for housing instability, not convenience.
If the child is with you because of a custody arrangement, a deployment, or a family decision made without housing pressure, you need a different enrollment path. A parental power of attorney or the standard enrollment process with proof of residency would apply instead.
The Enrollment Rules Under McKinney-Vento
When a child qualifies, the protections are strong:
- Immediate enrollment: The school must enroll the child even without a birth certificate, immunization records, proof of residency, or legal consent paperwork
- School of origin: The child has the right to stay in their previous school (the one they attended when permanently housed), with district-provided transportation if needed
- No delay for records: The receiving school must directly contact the previous school for records — the burden is on the district, not you
- Free school meals: Children identified under McKinney-Vento are automatically eligible for free meals through the National School Lunch Program

Finding Your District's McKinney-Vento Liaison
Every Kansas school district is required to have a designated Local Homeless Liaison registered with the Kansas State Department of Education (KSDE). This is the person you need to talk to — not the front-desk registrar who may not know the rules.
Call the school district's main office and ask specifically for the McKinney-Vento liaison or the homeless education coordinator. If the district gives you the runaround, contact KSDE directly — they maintain a list of every district's liaison.
What Happens When the District Disputes Eligibility
If a school district challenges whether the child qualifies under McKinney-Vento, the law requires that the child be enrolled immediately in the requested school while the dispute is resolved. The district cannot keep the child out during the appeal process.
Document everything: the date you attempted enrollment, who you spoke with, what they told you, and whether they enrolled the child or refused. This paper trail matters if you need to escalate.
McKinney-Vento Gets Them In — Consent Paperwork Keeps Them Covered
McKinney-Vento solves the enrollment problem, but it does not solve the ongoing consent problem. Once the child is in school, you still need authority to sign permission slips, consent to evaluations, attend IEP meetings, and take the child to the doctor.
If the housing situation that triggered McKinney-Vento eligibility is temporary, getting a parental power of attorney executed gives you documented authority for school decisions, medical consent, and dental care. Our Kansas School and Medical Consent Guide covers how McKinney-Vento and the Kansas consent instruments work together, so you are covered on both the enrollment and the ongoing authority sides.
