How to Appeal a DCF Denial in Kansas: Fair Hearing Process

A denial letter from Kansas DCF feels final. It isn't. Every caregiver whose benefits are denied, reduced, or terminated has the right to a fair hearing — an administrative review conducted by the Kansas Office of Administrative Hearings (OAH) that's separate from DCF itself.

The catch: deadlines are strict, and missing them means the denial stands.

The Notice of Action

When DCF denies, reduces, or terminates your benefits, they mail a written Notice of Action explaining what changed, why, and the effective date. This notice starts the clock on your appeal rights.

Read it carefully. Common reasons for kinship caregiver denials include:

  • Missing verification documents (birth certificate, residency proof, relationship documentation)
  • Income counted incorrectly (the caseworker included your income in a child-only TAF case)
  • Failure to respond to a Request for Information within the deadline
  • Household composition errors

Some denials are paperwork problems, not eligibility problems. If you were asked for documents and didn't respond in time, you may be able to reapply rather than appeal — but if the denial is based on an eligibility determination you disagree with, the fair hearing is your remedy.

Deadlines

  • TAF and childcare appeals: submit within 30 calendar days from the date on the Notice of Action
  • SNAP appeals: you have up to 90 calendar days
  • KanCare/Medicaid appeals: varies, but generally 30 to 90 days depending on the specific action

These are mailing-date deadlines — counted from when DCF mailed the notice, not when you received it.

How to Request Continued Benefits

If you file your appeal before the effective date of the adverse action or within 10 calendar days of receiving the notice (whichever is later), you can request continued benefits for the affected cash or food assistance while the hearing is processed.

This is critical. Without continued benefits, you lose assistance during the weeks or months it takes to schedule and resolve a hearing. With them, nothing changes until OAH makes a decision.

Filing the Appeal

Submit your fair hearing request in writing to the Kansas Office of Administrative Hearings in Topeka. You can:

  • Mail it to the address on the Notice of Action
  • Fax it
  • Deliver it in person

Keep a copy of everything you send, with the date. If you fax, keep the transmission confirmation. If you mail, consider certified mail with return receipt.

Your request doesn't need to be a formal legal document. A clear written statement that you disagree with the decision and want a fair hearing is sufficient. Include your name, case number, the date of the Notice of Action, and a brief explanation of why you believe the decision was wrong.

Preparing for the Hearing

At the hearing, you can:

  • Present documents and evidence
  • Bring witnesses
  • Explain your situation in your own words
  • Have a representative (a friend, family member, or legal aid attorney) speak on your behalf

Bring organized copies of everything: the Notice of Action, your original application, every document you submitted, any Requests for Information and your responses, and any evidence that supports your case (pay stubs, residency proof, relationship documentation).

Free Legal Help

Kansas Legal Services provides free legal representation to low-income Kansans, including kinship caregivers dealing with benefit denials. The Kids2Kin program specifically serves kinship families — though note that K2K referrals typically come through DCF Family Preservation. For general benefit appeals, contact KLS directly.

A common scenario for kinship caregivers: DCF counted your household income against the child's TAF eligibility when it should have been excluded under the child-only rules. That's exactly the kind of error a fair hearing can correct.

The Kansas Kinship Financial Help Guide includes an appeals calendar and tracking log to help you manage the deadlines and documentation for fair hearing requests across all DCF programs.
