Guardianship Filing Fee Alberta: Costs and How to Get a Fee Waiver

One of the first questions relatives ask when considering guardianship: how much is this going to cost? If you're a grandparent on a fixed income or a working relative who just absorbed the expenses of raising another child, every dollar matters. Here's what you'll actually pay at each stage.

Court Filing Fees

Alberta Court of Justice: $0 filing fee. You pay nothing to file your Form FL-10 (Claim) at the Court of Justice. This is one reason many self-represented applicants choose this court.

Court of King's Bench: $100 filing fee. Filing a Response (Form FL-11) costs nothing in either court, but the initiating Claim carries a $100 fee at King's Bench.

If the guardianship is intertwined with an ongoing contested divorce or family-property action between the child's parents, file in King's Bench regardless of the fee.

Background Check Costs

If the court orders background checks, or if you choose to include them with your application:

  • Police Vulnerable Sector Check (PVSC): $30 to $75 depending on your local police service or RCMP detachment. Processing times vary from a few days to several weeks.
  • Child Intervention Record Check (CIRC): Processed through Children and Family Services. Confirm any applicable fee with the department; processing times can be unpredictable.

Under the FLA route, background checks aren't automatically mandated — the judge has discretion to order them under Section 23(3). But many applicants include a recent PVSC with their FL-34 to demonstrate suitability upfront.

Other Potential Costs

Affidavit commissioning: Free at the courthouse for documents being filed with the court.

Process server: If you use a professional service to deliver documents instead of a friend or family member, expect $50 to $150 per party served, depending on location and complexity.

Copies and postage: Minor costs for producing certified copies of documents and mailing notices.

Document search or file inspection: $25 at either court if you need to search court records.

The Full Range — Self-Represented vs Lawyer

Filing on your own at the Court of Justice, you could complete the entire process for under $100 in out-of-pocket costs (mainly the police check). At King's Bench, add $100 for the filing fee.

With a lawyer, costs escalate significantly. Family lawyers in Alberta typically charge $200 to $450 per hour. A full guardianship matter — drafting affidavits, attending hearings, managing service — can run $3,000 to $7,500 or more depending on complexity and whether it's contested.

Legal coaching services (unbundled legal help) charge $150 to $350 per hour for document review and procedural guidance without full representation.

How the Fee Waiver Works

If you can't afford the $100 King's Bench filing fee, you can apply for a complete waiver. Submit a Fee Waiver Application with a sworn Financial Statement and supporting income documentation — pay stubs, AISH statements, income assistance vouchers, or CRA Notices of Assessment.

The waiver request must be approved before or at the time you submit your FL-10 for filing. You can't get a retroactive reimbursement for fees already paid.

Making the Numbers Work

For most relatives, the biggest cost isn't the filing — it's the time spent figuring out the process. The Alberta Private Guardianship Court Process Guide helps self-represented applicants avoid paid legal help for the procedural navigation, while flagging exactly when a lawyer's input is worth the expense.
