Free Legal Help for Kinship Caregivers in Manitoba

You Don't Have to Figure This Out Alone

Taking on a child you didn't expect to raise is overwhelming enough without trying to navigate government forms, court filings, and benefit applications by yourself. Manitoba has a network of free services specifically designed to help low-income families and caregivers — but they're scattered across different agencies, each handling a narrow slice of the problem.

Here's every free resource available to kinship caregivers in Manitoba, organized by what you actually need help with.

Legal Representation: Legal Aid Manitoba

If you need a lawyer for a guardianship application, a contested parenting arrangement, or a CFS matter, Legal Aid Manitoba provides free legal representation to qualifying low-income Manitobans.

Who qualifies: Your household income must fall below Legal Aid's financial eligibility threshold. If you're receiving EIA, you almost certainly qualify.

What they handle: Family law matters including guardianship orders (Form 70F), parenting arrangements, child protection proceedings, and appeals of government benefit decisions through the Public Interest Law Centre (PILC).

Offices: Winnipeg, Brandon, The Pas, Thompson, and Dauphin.

Contact: 1-800-261-2960 or visit legalaid.mb.ca

Legal Aid Manitoba also developed the In Loco Parentis Acknowledgement and Agreement — the key document that lets you access EIA child-only benefits without going to court. If you need help completing this form, their intake staff can walk you through it.

Legal Information (Not Representation): CLEA

The Community Legal Education Association (CLEA) doesn't represent you in court, but they provide something equally valuable: free legal information and a lawyer referral service.

Their Law Phone-In & Lawyer Referral Program offers:

  • Free legal information by phone
  • A free 30-minute consultation with a private lawyer
  • Plain-language fact sheets on family law topics including extended family parenting arrangements and child support

Contact: 204-943-2382 or toll-free 1-800-262-8800. Website: communitylegal.mb.ca

CLEA's published handouts on parenting arrangements under The Family Law Act are some of the clearest plain-language explanations available for Manitoba's updated terminology — where "custody" has been replaced by "decision-making responsibility" and "parenting time."

Drop-In Legal Clinics: The Legal Help Centre

If your household income is under $50,000 and you're representing yourself in a family matter, the Legal Help Centre offers free summary legal advice and drop-in clinics.

Location: 521 Bannatyne Avenue, Winnipeg Phone: 204-258-3096 Website: legalhelpcentre.ca

This is particularly useful if you're filing your own guardianship application and need someone to review your paperwork before you submit it to the Court of King's Bench registry.

Benefit Appeals: Public Interest Law Centre (PILC)

The Public Interest Law Centre, a division of Legal Aid Manitoba, specifically handles cases where government benefit decisions need to be challenged. If your EIA application under Section 5(1)(f) was denied or your benefits were reduced, PILC can help you prepare and present your case to the Social Services Appeal Board.

Remember: you have only 30 days from the date of a written EIA decision to file a Notice of Appeal. Don't wait to contact them.

Financial Counselling and Tax Help

Community Financial Counselling Services (CFCS) provides free budgeting help, debt counselling, and financial planning for low-income Manitobans. They also coordinate free tax clinics through the CRA's Community Volunteer Income Tax Program.

Filing your taxes every year — even with zero income — is essential. It triggers automatic payments of the Canada Child Benefit, GST/HST credit, and Manitoba Child Benefit. A missed filing year can suspend all three.

Free tax clinics operate across Manitoba from February through April, with some locations offering year-round service. CFCS can direct you to the nearest clinic.

Peer Support: Kinship and Foster Family Network

The Kinship and Foster Family Network of Manitoba is a province-funded peer support organization connecting caregivers with others in similar situations. They offer workshops, information sessions, and a network of people who understand the daily reality of raising a relative's child.

While their programming overlaps with licensed foster care, kinship caregivers in informal arrangements are welcome. Sometimes the most useful guidance comes from someone who has already navigated the same EIA intake process or CCB transfer.

The 211 Helpline

When you're not sure where to start, dial 2-1-1. Manitoba's 211 service connects callers to community, social, health, and government services across the province. They can help you identify which programs you might qualify for and provide direct referral phone numbers.

Available 24/7, in multiple languages, and completely free.

Manitoba Courts Family Resolution Service

If you're heading into a family law matter — whether it's a guardianship application or a contact order to maintain your relationship with a grandchild — the Family Resolution Service at Manitoba Courts offers triage screening and brief consultations to help you understand the process.

They maintain neutral-party status, so they won't advocate for you, but they can explain what forms you need, what the court timeline looks like, and whether mediation might resolve your situation without a full hearing.

Putting It All Together

Most kinship caregivers need help from multiple agencies simultaneously — Legal Aid for the In Loco Parentis form, EIA intake for the child-only benefit, CRA for the CCB transfer, and maybe a tax clinic to file a return that's been sitting. The Manitoba Kinship Financial Help Guide maps out all of these pathways in one document, with step-by-step application instructions and worksheets to track your progress across agencies.
