Free Caregiver Affidavit Form: Where to Find Your State's Official Version

You need a caregiver affidavit to enroll your grandchild in school, and you want to find the right form without paying a legal document website $40 for something that should be free. Good instinct — official caregiver forms are available at no cost where a state or district provides them.

Where to Find the Official Form

Your state Department of Education website. Search for "caregiver authorization affidavit" or "non-parent enrollment form" on your state DOE's site. Many states publish the form as a downloadable PDF.

Your local school district's enrollment page. Even when the state doesn't publish a centralized form, individual districts often create their own version that satisfies state law. Check the "enrollment" or "registration" section of the district website.

Your state's court self-help portal. California's Judicial Council publishes the official Caregiver's Authorization Affidavit on the California Courts self-help website. For other states, check the official education agency or district; the source of the form differs by state.

Grandfamilies.org. The Generations United Grandfamilies website maintains a state-by-state legal database showing which states have caregiver affidavit statutes and linking to relevant resources.

Legal aid organizations. Your state's Legal Services Corporation (LSC) affiliates, often called "legal aid" or "legal services," frequently publish plain-language caregiver affidavit guides and forms. These are free.

Why Generic Templates Don't Work

Etsy, Gumroad, and other creator marketplaces sell "temporary guardianship letters" and "childcare consent forms" for $5–$15. These are typically one-page informal letters stating that a child lives with a relative. A generic letter does not automatically carry the authority of a state caregiver affidavit. Use the official form when state law provides one.

School district legal departments frequently reject generic informal letters because they do not carry the authority of the applicable state form. In California, schools and other third parties that act in good faith on a completed statutory affidavit receive statutory immunity. An informal letter does not provide that California statutory protection.

What the Form Looks Like

The information requested depends on the state form. A caregiver authorization affidavit may ask for:

  • Your name, address, and date of birth
  • The child's name and date of birth
  • Your relationship to the child
  • A statement that the child lives in your home
  • The date the child began living with you
  • A declaration that the information is true under penalty of perjury
  • Your signature and the date
  • Any witness or notarization required by the form's signing instructions

California's form adds a second tier (Items 5–8) for relatives that expands authority to include medical and dental consent beyond school-related care. Your state's version may be simpler or more detailed depending on the statute.

What If Your State Doesn't Have a Specific Form?

Not every state has passed a formal caregiver authorization affidavit law. In these states, school districts typically use one of these alternatives:

  • A district-created "non-parent enrollment" form
  • A general affidavit of shared residence combined with proof that you're the child's primary caregiver
  • A notarized statement with the school's own required language

Call the school district's central enrollment office and ask what they accept from non-parent caregivers. They deal with this regularly and will tell you exactly what form to use.

If neither the state nor the district provides a form, ask the district about its non-parent enrollment process. If the child is sharing housing because of loss of housing, economic hardship, or a similar reason, the McKinney-Vento liaison can assess eligibility; qualifying students receive immediate enrollment without ordinary documentation.
