How to Enroll a Grandchild in School Without Custody in Massachusetts

You Do Not Need Custody to Enroll a Child

One of the most common misconceptions grandparents face is that you need a court order to register a child for school. In Massachusetts, that is not true. Under M.G.L. c. 201F, a Caregiver Authorization Affidavit gives you the legal standing to enroll the child, sign forms, attend disciplinary hearings, access educational records, and participate in IEP or 504 meetings — all without going to court.

The Department of Elementary and Secondary Education (DESE) has issued formal advisories directing all public school districts, charter schools, and superintendents to accept valid M.G.L. c. 201F affidavits for enrollment and educational decision-making.

What the School Will Ask For

For a standard enrollment, prepare two things: proof that the child lives in the district, and proof that you have legal authority to act as the child's educational decision-maker. The affidavit handles the second part. For residency, districts typically require:

  • Proof of address: utility bills, a lease, a property deed, or a landlord affidavit
  • Proof of the child's age: birth certificate, passport, or government ID
  • Immunization records: though if the child qualifies under McKinney-Vento, immediate enrollment cannot be delayed for missing records
  • Caregiver's photo ID

The number and type of residency documents vary by district. Boston Public Schools requires two proofs from separate categories plus a photo ID. Worcester requires one from "Column A" (lease, deed, or landlord affidavit within six months) and one from "Column B" (utility bill, paystub, or government letter within 60 days). Suburban and rural districts sometimes require three documents across distinct categories.

The Affidavit Does Not Create Residency

The Caregiver Authorization Affidavit proves your authority to make decisions for the child. It does not prove that the child lives in the school district. Those are two separate requirements. The child's enrollment right comes from physically living within the municipality — under M.G.L. c. 76, Section 5, every child has the right to attend the public schools of the city or town where they actually reside.

M.G.L. c. 201F explicitly prohibits using the affidavit to circumvent school district residency requirements. A child cannot use the form to attend school in a district where they do not live.

If the School Asks for Court Papers

Some front-desk staff still insist on a court custody order before enrolling a child. DESE has been clear that this is wrong — districts cannot demand judicial guardianship or custody papers when a valid Caregiver Authorization Affidavit is presented. If you encounter resistance:

  1. Show the DESE advisory notice alongside your executed affidavit
  2. Ask for a written explanation of the specific policy basis for the rejection
  3. Escalate to the district's central registrar, the director of student support services, or the superintendent
  4. If informal escalation fails, contact the Massachusetts Kinship Navigator at 1-844-924-4546 or a regional legal aid organization

Under M.G.L. c. 201F, Section 4, any school that accepts a valid affidavit in good faith is protected from liability. The law is designed to make acceptance easy.

Shared Tenancy and No-Lease Situations

If you live with another family member and do not have your own lease, most districts accept a landlord affidavit or shared tenancy affidavit signed by the primary leaseholder or homeowner. Boston Public Schools has a specific BPS Shared Tenancy Affidavit form. Worcester accepts a notarized landlord affidavit dated within six months.
